Whether part-time employees need to pay social security

Whether an employer needs to pay social security for a part-time employee depends on the relationship between the employee and the employer, if it is a labor relationship, there is no need to pay social security; if it is a labor relationship, the part-time employee needs to pay social security. Individual workers have the right to enjoy social insurance benefits in accordance with the law, and are able to supervise whether or not the organization pays contributions for them. Part-time employees are mainly: part-time employees, dispatched employees, special labor relations employees.

(1) part-time employees. According to the relevant legal provisions, the employer should pay for their only work injury insurance. The employee establishes labor relations with two or more units, and when a workplace accident occurs, the unit for which the employee works is the unit that bears the responsibility for workplace injury insurance. In other words, if the employing organization does not apply for work injury insurance for part-time employees, they will still be entitled to work injury insurance according to the law in the event of work accidents.

(2) Labor dispatch employees. A labor contract is concluded between the dispatched employee and the labor dispatching unit, so the labor dispatching unit needs to pay social insurance premiums to the dispatched employee and handle social security related procedures. If a dispatched employee suffers an accidental injury at the employing unit, the labor dispatching unit shall apply for work injury recognition in accordance with the law, and the employing unit shall assist in the investigation and verification of work injury recognition. The labor dispatch unit bears the responsibility of work injury insurance, but can agree with the employing unit on the compensation method.

(3) special labor relations employees. If the employer and its recruitment of people who have been entitled to pension insurance benefits or pensioners in accordance with the law, employment disputes, the people's court in the determination of labor relations should be dealt with according to the labor relations, it is not required to pay social security for such employees.
