Will Social Security Cards Be Forcibly Withheld by the Courts

Social security cards will not be forcibly deducted by the court. Social insurance funds shall not be seized, frozen or withheld in the hearing and execution of civil and economic dispute cases. Therefore, the money in the social security card about pension insurance and other related social insurance shall not be seized, frozen or deducted by the court.

The people's courts are the national judicial organs of the People's Republic of China, which has established specialized people's courts such as the Supreme People's Court, local people's courts at all levels and military courts. Its hearings are open to the public, except in special cases as prescribed by law. Defendants have the right to an opportunity to be defended.

The people's courts exercise judicial power independently on behalf of the State in accordance with the provisions of the law, and are not subject to interference by any administrative organs, social organizations and individuals or otherwise.

Legal basis:

Article 58 of the Law of the People's Republic of China on Social Insurance

An employer shall, within thirty days from the date of employment, apply to a social insurance agency for social insurance registration for its employees. If it fails to register for social insurance, the social insurance administration organization shall approve the social insurance premiums it shall pay.

Individual industrial and commercial households without employees who voluntarily participate in social insurance, part-time employees who do not participate in social insurance with their employers, and other flexibly employed persons shall apply to the social insurance administrative organization for social insurance registration.

The State establishes a nationally unified individual social security number. The personal social security number is a citizen's identity number.
