Can I still buy social security when I reach retirement age?

Legal analysis: In principle, it is stipulated that female employees and male employees of the employing unit shall not continue to participate in insurance as employees after reaching the age of 55 or 60, and the employing unit shall stop insurance in time when employees reach retirement age. According to the policy, only with the approval of organizations and human resources departments above the city, can the unit handle the payment procedures of over-age insurance for them.

Except for those who have been approved to postpone retirement and apply to the local tax department for continuing to participate in the insurance, the local tax department will force the over-age personnel who are still insured as employees to go through the automatic insurance suspension procedures, and inform the employer by mail, and the employer shall promptly remind the over-age insured personnel to receive pension benefits.

Workers who have reached retirement age must go through retirement formalities in time. If you continue to work, the length of service is not counted, and the overpaid pension insurance is not counted. After receiving the retirement fee, the unit can sign an agreement if it continues to work, but it can no longer pay social insurance. All treatment will be carried out in accordance with the agreement.

Legal basis: People's Republic of China (PRC) Social Insurance Law.

Article 2 When an individual participating in the basic old-age insurance for employees reaches the statutory retirement age, if the accumulated payment is less than 15 years, the payment may be extended to 15 years. After the implementation of the Social Insurance Law, if the extension of payment for five years is still less than 15 years, it can be paid in one lump sum until it reaches 15 years.

Article 3 After reaching the statutory retirement age, individuals participating in the basic old-age insurance for employees whose accumulated contributions are less than 15 years (including the extended payment as stipulated in Article 2) may apply for transferring to the new rural social endowment insurance or urban social endowment insurance where their household registration is located, and enjoy the corresponding old-age insurance benefits.

Individuals who participate in the basic old-age insurance for employees reach the statutory retirement age, and the accumulated payment is less than 15 years (including the extension of payment in accordance with the provisions of Article 2), and have not been transferred to the new rural social endowment insurance or urban residents' social endowment insurance, individuals can apply in writing to terminate the basic old-age insurance relationship for employees. After receiving the application, the social insurance agency shall inform it in writing of its right to transfer to the new rural social endowment insurance or urban residents' social endowment insurance and the consequences of terminating the basic endowment insurance relationship for employees. After my written confirmation, I will terminate the employee's basic old-age insurance relationship and pay me the amount stored in my personal account in one lump sum.
