Is the social security intermediary company legal?

Legal Analysis: Article 1 of the Interim Measures of Beijing Municipal Labor and Social Security Bureau on Acting for and Handling Archivists Entrusted by Individuals in Beijing and Retirees with Socialized Management to Participate in the Basic Medical Insurance Business stipulates that social insurance agencies shall go through the social insurance registration procedures at the district and county social insurance fund management centers within their jurisdiction in accordance with the current regulations of this Municipality before carrying out the basic medical insurance business. In other words, it is legal to accept the entrustment of the employer or individual workers and keep the personal files, labor personnel, social insurance and other labor security affairs for the entrusting party within a certain period of time.

Article 961 An intermediary contract is a contract in which the intermediary reports to the client the opportunity to conclude a contract or provides media services for concluding a contract, and the client pays the remuneration.

Article 962 The broker shall truthfully report to the client the matters related to the conclusion of the contract.

If the broker intentionally conceals important facts related to the conclusion of the contract or provides false information, which harms the interests of the client, he shall not ask for payment of remuneration and shall be liable for compensation.
