Can I lend my social security card to others?

According to the types of cardholders, social security cards can be divided into two categories, namely, social security (personal) cards issued to urban employees, unemployed people and retirees and social security (employer) cards issued to employers. The card planning and standardization of China's Ministry of Labor and Social Security focuses on social security (personal) cards, and the actual distribution in various regions is also concentrated on personal cards, so the social security cards we refer to refer to social security (personal) cards.

As the medical insurance policies in different regions are slightly different, take Tianjin as an example. Please consult the local social security department in other regions.

I. Provisions of Tianjin Municipality on Basic Medical Insurance

According to Article 52 of Tianjin Basic Medical Insurance Regulations (1), if the insured person commits one of the following acts, the administrative department of human resources and social security shall order him to return the defrauded medical insurance money and impose a fine of more than 2 times and less than 5 times the defrauded amount:

(1) Using another person's social security card for medical treatment or medicine purchase, or giving my social security card to another person for use;

(two) my social security card to the designated medical institutions or designated pharmacies;

(3) Forging or altering reimbursement documents and prescriptions;

(four) reselling basic medical insurance drugs.

If the insured person uses another person's social security card to see a doctor or buy medicine, or gives his social security card to others or designated medical institutions or pharmacies to defraud the basic medical insurance fund, the administrative department of human resources and social security shall order him to return the defrauded medical insurance money and impose a fine of more than 2 times and less than 5 times the defrauded amount. At the same time, the settlement method of medical expenses can be adjusted to 1 month to 1 year. During this period, the social security card stopped being used, and the medical expenses incurred by illegal participation were paid in full by myself according to the regulations.

Second, the case description

Legal Liability for Borrowing or Lending Social Security Cards (2)

From June 2065438 to June 2004, the law enforcement officers of the Medical Insurance Supervision Office found that Cui's social security card information was red in the real-time monitoring system during the daily screening of the real-time monitoring system, especially the indicators such as drug frequency and expenses exceeded the monitoring threshold designed by the system. In the first five months alone, the outpatient fee was more than 30 thousand yuan, and the average monthly drug fee was as high as 7000 yuan. There is a serious phenomenon of over-purchasing drugs. What is even more strange is that the card is based on the "traffic light" hierarchical supervision mode and combined with the "warning line" management function. Law enforcement officers believe that the social security card has a disease of illegal behavior. Law enforcement officers immediately stopped Cui's social security card and conducted an interview and on-site investigation on Cui. After investigation and verification, Cui admitted to lending his social security card to Wang. Cui's colleague Wang borrowed Cui's social security card to see a doctor because he didn't take insurance in this city after leaving his job. Considering that the two have a good personal relationship, Cui did not refuse. Cui himself has no special illness, but Wang registered Cui by forging medical records and other means, thus using Cui's social security card to take a large number of medicines, and at the same time taking a large number of medicines for his family. Cui failed to stop Wang's behavior when he knew it clearly, and he should bear the corresponding responsibility.

Punishment result: According to the relevant regulations of medical insurance in our city, the medical insurance supervision office severely criticized Cui, ordered him to return the defrauded medical insurance fund of 29,000 yuan, canceled the false special registration, and adjusted his medical expenses settlement method.

Case study:

At present, the city requires the insured to issue their own social security card when seeking medical treatment. The social security card is not only the identity certificate of the insured, but also the protection of the rights and interests of the insured patients. Some insured people use other people's social security cards to buy medicines, lend their social security cards to others or give them to designated medical institutions and pharmacies for use, which violates the provisions of basic medical insurance, not only causing losses to medical insurance funds, but also bringing risks to cardholders themselves, which objectively encourages insurance fraud. According to the Regulations of Tianjin Municipality on Basic Medical Insurance and the Measures of Tianjin Municipality on Medical Supervision and Management of Basic Medical Insurance, the administrative department of human resources and social security shall order the insured to return the defrauded medical insurance money, impose a fine, adjust the settlement method of medical expenses, stop using credit cards for reimbursement, and fully reimburse the medical expenses incurred, even if the circumstances are serious. If the masses find illegal use of social security cards, they can report complaints to the municipal medical insurance supervision office.

Third, why can't social security cards be lent to others?

1. Let's talk about the first point, which may affect your insurance.

The social security card records all the data of personal medical treatment and drug purchase. When you lend out your card, it is equivalent to giving yourself all the diseases and medicines that the other person has seen. If it's just a minor illness such as a cold and fever, if the other party uses it to buy some drugs such as heart disease and hypertension, or other diseases that insurance companies are very taboo, that's fine. You basically bid farewell to the opportunity to buy commercial insurance. Even if you try your best to prove that you didn't see the disease, it's no use if you didn't take the medicine. The insurance company still has good reasons to refuse you:

If you buy medicine, it means that you are unhealthy and refuse insurance;

If you don't buy medicine, you are cheating others. Is it dishonesty or refusal to insure?

Not only is it difficult to buy new insurance, but the previous insurance and claims may also be affected: for example, if you buy a medical insurance, now you have a heart problem and have to pay for it. But the insurance company checked your medical insurance records and found that you lent your card to your relatives a few years ago and bought heart medicine. The insurance company thinks that you didn't "tell the medical history truthfully" when you bought insurance, so you refused to pay.

2. Legal liability

Social security cards are unique, just like ID cards. If you lend it to others, help them buy medicine, see a doctor and reimburse them, to put it bluntly, it is to defraud the national medical insurance fund. Is to be punished. If the social security department finds that the frequency and habits of using your social security card are different from those of normal people, such as buying a lot of medicines in a short time and seeing many different kinds of diseases, it may freeze your social security card and invite you to tea. If it is found that there is insurance fraud, it is necessary not only to recover all the reimbursed money, but also to impose a fine of 2-5 times. If the amount is huge and the circumstances are serious, you may go to jail.

The record in the social security card has been following you, which is actually equivalent to another letter asking for a report. If you lend someone else to have a baby for reimbursement, then you are equivalent to having one more child; If you lend others to buy medicine and resell it, there will be dozens of related diseases;

In short, social security cards are very important, and now there are more and more additional functions, no less than ID cards. Don't lend it to others casually and make fun of your credit.
