I. The Maternity Insurance Fund reimburses units in the form of maternity allowance. The maternity allowance is calculated on the basis of the average monthly maternity insurance contribution salary of the 12 months prior to the date of delivery or the date of the family planning operation of the female worker. (b) Maternity nutrition subsidy and perinatal health care subsidy. Any female worker who has given birth and is eligible for maternity leave of 90 days or more as stipulated by the State is entitled to a maternity nutrition subsidy of RMB 300 yuan and a perinatal health care subsidy of RMB 700 yuan. (c) One-time maternity subsidy. When a female worker who originally participated in maternity insurance at her workplace becomes unemployed and gives birth in accordance with family planning regulations during the period in which she receives unemployment insurance benefits, she will be entitled to a one-time maternity subsidy of RMB 400 yuan for a miscarriage, RMB 2,400 yuan for a smooth birth, and RMB 4,000 yuan for a difficult birth or a multiple birth; for a male worker who participates in maternity insurance, and whose spouse is not included in the coverage of the maternity insurance, and gives birth to his or her first child in accordance with the regulations on family planning The one-time maternity allowance is 50% of the total amount of the allowance. (iv) Maternity allowances are compensated to the unit, and the basic salary, bonuses and welfare payments of the insured female worker are paid by the unit during her maternity leave. V. Family planning surgical expenses, including expenses incurred for the placement (removal) of intrauterine devices, abortions, induced abortions, skin burials, sterilizations and restorative surgeries due to the need for family planning, are included in the scope of the maternity insurance fund settlement.
Legal Objective:Article 8 of the Special Provisions for the Labor Protection of Female Workers and Employees, the maternity allowance during the maternity leave of a female worker shall be paid by the Maternity Insurance Fund in accordance with the standard of the average monthly salary of the employees of the employing unit in the previous year for those who have participated in the maternity insurance; for those who have not participated in the maternity insurance, the allowance shall be paid by the employing unit in accordance with the standard of the salary of the female worker prior to the maternity leave.
