Flexible employees participate in insurance as individuals, because no unit pays for it, and all expenses are borne by individuals. The insured persons with flexible employment status are basically divided into two categories, one is insured as an individual from beginning to end, and the other is insured as an individual after leaving the work unit for various reasons.
If the insured with flexible employment has worked in the unit, it may still be regarded as the same payment period and additional transitional pension.
Therefore, whether retirees are regarded as payment years is not directly related to their status at retirement, but mainly depends on their working years before retirement.
In other words, employees who retire on the job do not necessarily have the same payment period, and employees who participate in flexible employment do not necessarily have the same payment period. What is the standard of deemed payment period?
According to the State Council's Notice on Deepening the Reform of the Pension Insurance System for Enterprise Employees, before the implementation of the individual payment system, the continuous service of employees can be regarded as the payment period.
The deemed payment period refers to the continuous working period calculated by the state before the actual payment period of the insured employees.
Specifically, it can be divided into the following situations:
One is to fix the working years of employees before the implementation of the basic old-age insurance system for enterprises and employees.
Second, after the formal employees of government agencies and institutions are transferred to enterprises, they should participate in the basic old-age insurance for enterprise employees, and their original working years are regarded as payment years.
Third, the length of military service of demobilized veterans who participate in the basic old-age insurance can be regarded as the payment period.
Fourth, if the educated young people from cities and towns who go to the countryside are recruited as contract workers and participate in the basic old-age insurance, the continuous length of service calculated according to state regulations during the period of going to the countryside is regarded as the payment period.
Flexible employees, as a special group participating in employee social security, may be regarded as the payment period by the social security department if the above situation exists.
Why not say that there must be a deemed payment period?
Because of retirement, it is not up to you to decide whether it is regarded as the payment period. The social security department must check the relevant evidence materials and meet the conditions before it can be deemed as the payment period.
When flexible employees meet the following three conditions at the same time, they will be regarded as having the same payment period.
The first condition is whether the place where the flexible employees are located has officially joined the work and has a continuous length of service before the establishment of the individual payment system for endowment insurance. Continuous length of service refers to the length of service that can be calculated continuously according to law, including the length of service of this unit and the length of service previously calculated in other units according to law. After 1987, its scope is not limited to working hours in a unit, but includes all working hours that employees should be included in each unit according to regulations.
The second condition is to work in a state-owned enterprise or institution at or above the county level or a large collective.
The third condition is whether there is a personnel file as proof.
If you have worked in private enterprises or joint ventures, because these enterprises have no personnel rights, they will not have personnel files and cannot enjoy the same payment period.
In addition, even if individuals do have work experience in state-owned enterprises, institutions or large collectives, if they are only temporary workers without preparation, there is no way to identify them as payment years.
On the whole, whether there is a deemed payment period is inseparable from the relevant information records of personal personnel files, and there is no evidence. Even if an individual has worked in a state-owned enterprise or a large collective enterprise, it is difficult to be regarded as having the same payment period without files as evidence. This shows how important the personnel files are when you retire.
