Can the branch pay social security?

Legal analysis: As a branch of the head office, a branch company does not have the qualification of an independent legal person and cannot pay social insurance for its employees independently, but it can be solved in the following two ways:

1. Pay social security fees to employees, and employees purchase social security by themselves;

2. Pay social security for employees at the place where the head office is registered.

According to Article 14 of the Company Law, a company may set up branches. The establishment of a branch company shall apply to the company registration authority for registration and obtain a business license. A branch company does not have legal person status, and its civil liability shall be borne by the company.

A company may set up subsidiaries, which have legal personality and independently bear civil liabilities according to law.
