How to pay social security in the month of resignation

In the month of resignation, the employer will continue to pay social security, as follows:

1. This is clearly stipulated by relevant laws. If the employee terminates the labor relationship with the employer, the employer shall pay social security to the employee in the month when the employee leaves his job.

2. However, next month after the termination of the labor contract, the employer does not need to pay the relevant social security, and the employee can pay it himself or transfer the social security relationship to a new work unit.

It is not illegal to stop paying social security in the month of resignation. The Social Insurance Law does not stipulate that employees can stop paying social security in the month when they leave their jobs, or they cannot stop paying social security. Generally speaking, during the employee's employment, the employer has to pay social security. If they leave, the employer is allowed to leave that month.

Legal basis: Article 58 of People's Republic of China (PRC) Social Insurance Law.

The employing unit shall, within 30 days from the date of employment, apply to the social insurance agency for social insurance registration for its employees. If the social insurance has not been registered, the social insurance agency shall verify the social insurance premium it should pay.

Employees-free individual industrial and commercial households who voluntarily participate in social insurance, part-time employees who do not participate in social insurance in the employing unit and other flexible employees shall apply to the social insurance agency for social insurance registration.

The state establishes a national unified personal social security number. Personal social security number is a citizen's identity number.
