Relevant documents of social security for migrant workers in Beijing

The social security compensation for migrant workers shall be implemented according to the documents: from the signing of the contract, it shall be paid once every six months until the dismissal.

According to the relevant regulations, migrant workers fail to pay social insurance, and the unit can only compensate afterwards, but can't pay it back.

Document No.99 (1999) issued by the former Beijing Municipal Labor Bureau, Interim Measures of Beijing Municipality for Farmers' Contract Workers to Participate in Old-age Insurance and Unemployment Insurance, stipulates that the employer shall sign labor contracts with farmers' contract workers and go through the formalities of participating in old-age insurance and unemployment insurance for them from the month of employment. At the same time, Article 22 stipulates: "If a farmer contract worker cannot enjoy the pension insurance and one-time living allowance because the employer has not participated in social insurance or paid the pension and unemployment insurance premiums in full, the employer shall compensate him according to the standards stipulated in these Measures."

200 1 promulgated the Interim Measures of Beijing Municipality on Endowment Insurance for Migrant Workers, which also stipulates that the employing unit shall sign labor contracts with migrant workers from the month when they are recruited, and handle the formalities of participating in endowment insurance for them. At the same time, Article 15 stipulates that "if migrant workers are unable to enjoy the pension insurance benefits as required because the employer fails to participate in social insurance or fails to pay the unit and individual pension insurance premiums in full, the employer shall compensate them according to the standards of these Measures."

The above-mentioned documents clearly stipulate that if the employer fails to pay insurance for migrant workers, it can only compensate them, but not refund them. Therefore, in order to protect their legitimate rights and interests, migrant workers need to always supervise the unit to pay social insurance in full for themselves in time to avoid repeating Ms. Gao's mistake.
