According to the relevant provisions of the Interim Regulations on the Collection and Payment of Social Insurance Fees in the State Council and the Interim Measures for the Collection and Payment of Social Insurance Fees by the provincial government, combined with the actual situation in our city, we now put forward the following opinions on the issues related to expanding the coverage of old-age insurance:

The first is to raise awareness and ensure a major breakthrough in the full coverage of old-age insurance.

Expanding the coverage of old-age insurance is not only the need to implement the "two guarantees" and earnestly safeguard the legitimate rights and interests of the broad masses of workers, but also the need to adapt to China's accession to the WTO, establish a sound market mechanism and a market environment of equal competition, and realize the full coverage of old-age insurance. It is a very important content that embodies the principle of national treatment and non-discrimination. Therefore, expanding the coverage of old-age insurance is not only of great practical significance, but also of long-term political and economic significance. At present, the coverage of endowment insurance in our city has achieved rapid development. State-owned enterprises and collective enterprises have basically achieved full coverage, and the coverage of other urban enterprises and individual industrial and commercial households is also expanding, but there is still a certain gap compared with the requirements of full coverage. In order to establish and improve the social security system and bring all workers into the "safety net" of social insurance, governments at all levels and relevant departments should fully understand the importance of doing this work well, enhance their sense of urgency and responsibility, regard expanding the coverage of old-age insurance as a "popular project" to do practical things for the masses, strengthen measures, pay close attention to implementation, and ensure a major breakthrough in expanding coverage.

According to the Provisional Regulations on the Collection and Payment of Social Insurance Fees and the Interim Measures for the Collection and Payment of Social Insurance Fees in Hebei Province, all state-owned enterprises, urban collective enterprises, foreign-invested enterprises, Hong Kong, Macao and Taiwan-invested enterprises, urban private enterprises and other urban enterprises and their employees, urban individual industrial and commercial households, freelancers, informal employees and all kinds of flexible employees in our city should be included in the coverage of old-age insurance according to law. Labor and social security departments at all levels and social insurance agencies should take effective measures to continuously improve their services and include all enterprises and individuals that should be included in the old-age insurance. On the basis of full coverage of state-owned enterprises and collective enterprises, we will focus on bringing state-owned enterprises and foreign-invested enterprises, Hong Kong, Macao and Taiwan-invested enterprises, urban private enterprises and other urban enterprises and their employees, as well as urban individual industrial and commercial households, freelancers, informal employees and all kinds of flexible employees into the coverage of old-age insurance.

Foreign-invested enterprises and Hong Kong, Macao and Taiwan-funded enterprises, regardless of joint venture, cooperative operation or sole proprietorship, or joint venture and cooperative operation with enterprises of any nature in our city, as long as they comply with the relevant laws and regulations of our country and are registered in our city, enterprises and their employees must participate in endowment insurance according to law; Private enterprises in cities and towns, regardless of the status of natural person investors or the mode of operation, should participate in endowment insurance according to law as long as they are registered in industry and commerce. Urban individual industrial and commercial households, freelancers, informal employees and other flexible employees should be included in the coverage of old-age insurance in accordance with relevant policies and regulations as long as they meet the conditions for inclusion in old-age insurance.

Third, the proportion of contributions and pension plans.

(1) State-owned enterprises, urban collective enterprises, foreign-invested enterprises, Hong Kong, Macao and Taiwan-invested enterprises, urban private enterprises and other urban enterprises shall pay 20% of the total wages in the current month (the total monthly wages shall be calculated according to the caliber specified by the National Bureau of Statistics), and individual employees shall pay 7% of the monthly wages, and then increase by one percentage point every two years, eventually reaching 8% of the wages. The endowment insurance premium paid by individual employees shall be withheld and remitted by the employer.

(2) Private entrepreneurs, urban individual industrial and commercial households, freelancers, informal employees and all kinds of flexible employees pay the old-age insurance premium at 18% of the average salary of employees in the province last year.

(3) According to the principle of combining social pooling with personal accounts, social insurance agencies set up lifelong personal accounts for basic old-age insurance for those who participate in the basic old-age insurance, and the personal accounts are credited to 1 1% of the wages paid by themselves, of which 7% paid by individuals is credited in full, and the remaining 4% is included in the old-age insurance premiums paid by employers. With the increase of the proportion of individual contributions, the share of the unit should be gradually reduced to 3%. Personal accounts of private entrepreneurs, urban individual industrial and commercial households, freelancers, informal employees and various flexible employees are transferred according to 1 1%, which are all regarded as individual contributions. Personal contributions in personal accounts are completely owned by individuals and can be inherited. Workers flow between public-owned enterprises and non-public-owned enterprises, and the payment period is calculated cumulatively.

(4) Employees of non-public enterprises participating in social endowment insurance can enjoy the same retirement benefits as employees of state-owned enterprises when they reach the statutory retirement age and the payment period (including deemed payment period) reaches 15 years, and receive basic endowment insurance from social insurance institutions on a monthly basis. Urban individual industrial and commercial households, freelancers, informal employees and all kinds of flexible employees who participate in the old-age insurance, men over 60 years old and women over 55 years old, can receive the basic pension on a monthly basis according to the regulations after the accumulated payment period reaches 15 years.

Farmers' contract workers who have reached the age of 60 for men and 55 for women, and have accumulated payment period of 15, can receive basic pension according to regulations; If the accumulated payment period is less than 15 years, all the savings in his personal account will be paid to him in one lump sum, and the pension insurance relationship will be terminated at the same time.

(five) in order to safeguard the legitimate rights and interests of employees, the age of insurance is appropriately relaxed. If the first-time insured persons are under 50 years old for men and 40 years old for women, and the payment period is less than 15 when they reach the statutory retirement age, they are allowed to pay the social endowment insurance premium to 15 in one lump sum and receive the basic pension according to the regulations.

Four. Continuation and transfer of endowment insurance relationship

1. Employees who participate in the endowment insurance for employees of urban enterprises, regardless of the reason why their work units have changed, include enterprises and employees transformed through corporate system reform, shareholding system reform, sale, auction and lease. , as well as cross-regional flow of personnel, to continue to participate in pension insurance in accordance with the provisions, pay in full and on time. No unit may interrupt the employee pension insurance relationship for any reason.

2, employees and enterprises to terminate or terminate the labor relationship, employee pension insurance relationship retained by the social insurance institutions responsible for the management. No matter in what form, enterprises in our city should go to social insurance agencies to continue the old-age insurance relationship, and pay the old-age insurance premium according to the regulations, and the payment period is calculated cumulatively.

3. All kinds of employers must sign labor contracts with employees with rural hukou according to regulations, and organize them to participate in the basic old-age insurance for urban enterprise employees. When the employee terminates or terminates the labor relationship with the employer, the social insurance agency shall keep its pension insurance relationship, keep its personal account and bear interest. Where re-employment, should continue or transfer the pension insurance relationship. According to the employee's own application, he can also pay all the storage amount in his personal account in one lump sum and terminate the pension insurance relationship at the same time.

4, the insured workers cross the scope of overall planning or flow within the scope of overall planning, should be timely to the social insurance agencies for the transfer of pension insurance relations. The transfer amount is the accumulated principal and interest paid by the individual before the date of 1998 1, plus the total storage amount credited to the individual account since the date of 1998 1.

Five, take effective measures to fully implement the task of expanding old-age insurance.

It is the obligation of every enterprise and employee to participate in social pooling of endowment insurance according to law and pay endowment insurance premiums in full and on time. Any employer and individual must implement it unconditionally. In order to enhance the transparency of this work, strengthen supervision and inspection, and ensure a breakthrough in the expansion of endowment insurance, we must strictly adhere to the following points:

1. Governments at all levels are the first responsible persons for social insurance. In order to ensure a major breakthrough in expanding the coverage of old-age insurance, the municipal government decided to launch a surprise campaign to expand the coverage of old-age insurance in the first half of the year. Governments at all levels should attach great importance to this surprise activity, coordinate the relationship between various functional departments, concentrate manpower and material resources, and make good use of legal, economic and administrative means to achieve good results. We should do a good job in propaganda and launch, and form a strong public opinion momentum in the whole society; We should conscientiously do a good job in investigation, go deep into streets and enterprises, and conduct a dragnet investigation to achieve a targeted goal; To strictly implement the target responsibility system, governments at all levels and labor and social security departments should clarify their responsibilities, establish the target responsibility system at all levels, and earnestly do a good job in expanding the coverage of old-age insurance; Establish a scheduling system and a notification system, and the Municipal Labor and Social Security Bureau will schedule the progress of county (city, district) expansion on a monthly basis. 2, labor and social security departments at all levels should strengthen labor security law enforcement supervision, strengthen labor contract management, improve the employment system. The labor and social security department shall establish an annual inspection system for labor security. For employers who fail to participate in endowment insurance and pay endowment insurance premiums in full and on time, the labor and social security department shall not handle labor business such as labor contract verification, salary examination and approval, and work-related injury identification. If the circumstances are serious, a fine of 1000 yuan or more may be imposed on the directly responsible person in charge and the enterprise as a legal person in accordance with the Provisional Regulations on the Collection and Payment of Social Insurance Fees (Order No.259 of the State Council). A fine of less than 5,000 yuan, if the circumstances are particularly serious, shall be exposed, in addition to a fine of more than 5,000 yuan10,000 yuan for the directly responsible person in charge and the enterprise as a legal person, and at the same time apply to the court for compulsory execution.

3. Local tax authorities at all levels should fully implement the provincial government's decision on the collection of old-age insurance premiums for employees of urban enterprises by local tax authorities, collect old-age insurance premiums in strict accordance with the Interim Measures for the Collection and Payment of Social Insurance Fees in Hebei Province, and strengthen the collection, management and inspection of social old-age insurance premiums. For employers and individual workers who fail to apply for social insurance registration or declare and pay social endowment insurance premiums according to regulations, tax registration and invoice collection shall be suspended.

4. The administrative departments for industry and commerce at all levels should take participating in endowment insurance as one of the prerequisites for the annual inspection of enterprises and individual workers. Employers and individuals participating in the annual inspection are required to show the annual inspection certificate of the labor and social security department. For the units and individuals who did not participate in the annual inspection of labor security because they did not participate in the endowment insurance, the industrial and commercial departments shall suspend the annual inspection procedures, and the business license may be revoked if the circumstances are serious.

5, the financial departments at all levels should increase investment in social insurance agencies office funds and information management system construction, to expand the coverage of old-age insurance to implement a special reward system, to ensure the normal work.

6. Trade union organizations at all levels should base themselves on safeguarding the legitimate rights and interests of employees, give full play to the role of democratic supervision of enterprise employees, assist labor and social security departments to promote stable and harmonious labor relations between enterprises and employees by establishing an equal consultation mechanism and improving the collective contract system, and take endowment insurance as an important part of collective contracts and labor contracts, and pay close attention to it.

7. Propaganda departments at all levels should give full play to the role of the news media in propaganda and public opinion supervision, increase the propaganda of social security work, carry out various forms of propaganda work, and vigorously create an atmosphere of participating in social insurance according to law. Newspapers, radio stations and television stations should set up "social security window" columns to systematically publicize the basic knowledge of social insurance and the principles and policies of the party and the government on social insurance. Summarize the typical propaganda, and resolutely expose the units and individuals who refuse to participate in insurance or refuse to pay endowment insurance premiums.
