Suzhou Maternity Allowance 2022 Payment Standard
A female employee who participates in maternity insurance can enjoy maternity insurance treatment and receive maternity allowance after giving birth to a child. The formula for calculating the maternity allowance: the average monthly salary of the employee's employer/30 x the number of days of maternity leave, and the main body that bears the maternity allowance for the employee is the social security institution. Under normal circumstances, the maternity allowance is first issued by the social security agency to the unit account, and then issued by the unit to the individual account; not participate in maternity insurance, the employer's former female employees wages paid by the employer.
Female workers enjoy maternity allowance and medical subsidies during maternity leave; if the maternity allowance is higher than the average wage of the employees, the company no longer needs to pay maternity leave wages; if it is lower than the average wage, the company needs to make up the difference. If the period of payment of maternity allowance exceeds the period of payment of maternity allowance, or the standard of maternity allowance is not reached, or the company has not paid maternity insurance to the employee, the employee can ask the company to pay the maternity leave wages.
The law does not specify the difference between a caesarean section and a normal birth in maternity leave. According to the latest national regulations on maternity leave, the maternity leave for pregnant women has been increased from 90 days to 98 days, while the maternity leave for mothers with late-term childbearing has been increased by another 30 days to a total of ****128 days. Maternity leave refers to the leave entitlement before and after the maternity period for working women, generally from half a month before to two and a half months after delivery, and female workers enjoy no less than ninety-eight days of maternity leave for childbirth. Those who are already covered by maternity insurance are entitled to benefits such as maternity allowance, which is paid by the Maternity Insurance Fund at the rate of the employer's average monthly wage for the previous year.
2022 Suzhou new standards for maternity leave:
1, female workers give birth to enjoy 98 days of maternity leave, of which 15 days of prenatal leave can be taken;
2, difficult birth, an additional 15 days of maternity leave;
3, the birth of multiple births, each additional birth of a baby, additional maternity leave of 15 days;
4, less than 4 months of pregnancy miscarriage, enjoy 15 days of Maternity leave;
5. 42 days of maternity leave if the pregnancy has been aborted for four months;
6. Maternity leave for late childbearing shall be stipulated by provinces, autonomous regions and municipalities directly under the Central Government in accordance with the regulations on family planning of the respective provinces.

Article 5 stipulates that employers shall not reduce the wages of female workers, dismiss them, or terminate their labor or employment contracts because of their pregnancy, childbirth, or breastfeeding. This legally guarantees that women's maternity leave is paid leave, and it is the most basic maternity leave pay provision.
