Paragraph 2 of Article 42 of the Property Law stipulates:

"To expropriate collectively-owned land, land compensation fees, resettlement subsidies, ground attachments and young crops compensation fees shall be paid in full according to law, and social security fees for land-expropriated farmers shall be arranged to ensure their livelihood and safeguard their legitimate rights and interests." However, the "full amount" standard is not the "full amount" compensation of market value, because rural land is not completely marketized and its real market value cannot be effectively calculated. The so-called "full amount" refers to the cost value of land, that is, land compensation fees, resettlement subsidies, ground attachments and young crops compensation fees.

According to Article 47 of the Land Management Law, the land compensation fee is 6 to 10 times of the average annual output value of the cultivated land in the three years before expropriation. Once rural land is developed into commercial land, its market value may be far higher than 6 to 10 times the average annual output value when it is used as cultivated land.
