Legal Basis

The People's Republic of China (PRC) Law on Military Service Article 53 For conscripts who have left active service, the State shall take the measures of self-employment, job placement, and support for proper placement.

If conscripts are withdrawn from active service and employed on their own, they shall be paid a one-time retirement pension in accordance with State regulations, and shall be received by the local people's government at or above the county level of the place where they are to be resettled, and, in the light of the actual situation in the locality, they may be given economic subsidies. The State adjusts the standard of the retirement pension in due course in accordance with economic and social development.

During their active service, conscripts who have received more than second-class honors in peacetime or more than third-class honors in wartime, as well as those who are the children of martyrs, shall be arranged for work by the local people's government at or above the county level of the place of their placement; during the period of time in which they are to be arranged for work, they shall be given living allowances by the local people's government in accordance with the relevant provisions of the State; and, on the basis of their own volition, they may also opt for employment on their own initiative.

Disabled conscripts who left active service because of war, public service, or illness shall be properly resettled in accordance with the State's regulations on the evaluation of disability levels by means of job placement and support; those who meet the conditions for job placement may, of their own volition, choose self-employment.
