II. The introduction of maternity allowance is a guarantee for the basic life of female workers. Female workers leave their jobs during maternity and cannot work normally. The State, through the formulation of relevant policies, guarantees that they will enjoy the relevant treatment during their absence from work. These include maternity allowances, medical services and a special protection policy for women workers who are unable to carry out their normal work during pregnancy. In terms of both livelihood and health protection, favorable conditions have been created for the smooth delivery of pregnant women.

Thirdly, the introduction of maternity benefits is a necessity for improving the quality of the population. Women give birth to children who are physically exhausted and need adequate rest and supplementary nutrition. Maternity insurance provides them with a basic salary so that their standard of living is not lowered as a result of leaving work, and also provides them with medical service programs, including maternity checkups and perinatal health care guidance to monitor the normal growth of the fetus. For women who are sick or exposed to toxic and harmful substances during pregnancy, necessary examinations are done. If a deformed child is found, the pregnancy can be terminated at an early stage. Maternity leave wages: During the period of maternity leave, the employer shall not reduce the wages, dismiss or otherwise terminate the labor contract of a working woman. Working women on maternity leave are entitled to maternity insurance, with the social security fund reimbursing the relevant medical expenses and granting maternity allowances; if a working woman is not enrolled in maternity insurance, the employer will bear the burden.

The standard of maternity leave now officially implemented in China is based on the "Special Provisions on Labor Protection for Female Workers and Employees (Draft)," which was considered and adopted in principle by the State Council at its April 18, 2012 executive meeting. The draft extends the maternity leave enjoyed by female workers for childbirth from 90 days to 98 days and regulates related treatment.

Maternity leave entitlements:

First, for birth control leave, wages are paid according to sick leave

Secondly, for prenatal leave, the salary is paid at 80%.

Pregnancy of more than seven months, if the work permits, upon application, the unit approved, can take prenatal leave of two and a half months. Part of the cases belonging to the local regulations stipulating that the leave must be given, the unit shall approve the leave and the salary shall be paid according to 80% of the employee's previous monthly actual salary rate.

Third, maternity leave, maternity allowance

In areas where maternity insurance is socially coordinated, the payment standard is based on the enterprise's average monthly wage of the previous year's employees; in areas where maternity insurance is not socially coordinated, the maternity allowance will be paid by the enterprise or unit, and will be based on the basic wage of the female employee prior to the birth of the child and the price subsidy.

Maternity leave consists of 98 days + 30 days (for late childbearing) + 15 days (for difficult births) + 15 days (for multiple births, for each additional baby) to receive the maternity allowance. Maternity allowance is a state subsidy to enterprises, used to pay wages during maternity leave, but it is calculated with the company's declared wage base in the social security office, so the actual maternity allowance and maternity leave wages are not equal, so there are provisions: maternity leave wages and maternity allowance, on the higher to receive, in short:

1. If the employee's maternity leave wages (i.e., the employee's previous monthly actual wage standard If the employee's maternity leave salary (i.e. the employee's previous monthly paid salary) is higher than the maternity allowance, it is OK to send the employee according to the maternity leave salary, and the maternity allowance is down to the enterprise.

2. If the employee's maternity leave wage is lower than the maternity allowance, then you can first send the employee according to the maternity leave wage, and then the maternity allowance down to the difference with the maternity leave wage to make up for the difference to the employee, and the rest is still attributed to the enterprise.

Fourth, breastfeeding leave, six and a half months in accordance with 80% of the salary, and then extend the period at 70%.

After the birth of a female employee, if there are difficulties and work permits, by their own application, approved by the unit, you can take breastfeeding leave for six and a half months, the wage according to the employee's previous monthly salary standard 80% of the pay, and then extend the period of seventy percent of the pay.
