Notice of the Ministry of Labor and Social Security on Issuing the Interim Measures for the Administration of Social Insurance Registration

Chapter I General Provisions Article 1 In order to strengthen and standardize the administration of social insurance registration, these Measures are formulated in accordance with the Provisional Regulations on the Collection and Payment of Social Insurance Fees (hereinafter referred to as the Regulations). Article 2 All units that are required to pay social insurance premiums according to Articles 2, 3 and 29 of the Regulations shall register social insurance in accordance with the provisions of these Measures and obtain social insurance registration certificates. Article 3 The social insurance agency of the administrative department of labor security at or above the county level (hereinafter referred to as the social insurance agency) is responsible for social insurance registration. Fourth social insurance agencies should cooperate with relevant departments to strengthen the management of social insurance registration. Chapter II Registration Article 5 Payment units engaged in production and business operations shall, within 30 days from the date of obtaining the business license, and non-production and business operations units shall, within 30 days from the date of establishment, apply to the local social insurance agency for social insurance registration. Payment units that did not participate in social insurance before the implementation of the "Regulations" shall, in accordance with the provisions of Article 8 of the "Regulations", apply to the local social insurance agency for social insurance registration with the documents and materials specified in Article 7 of these Measures.

Payment units that have participated in social insurance before the implementation of the Regulations shall re-apply for social insurance registration at the local social insurance agency in accordance with the provisions of the preceding paragraph. Article 6 Social insurance registration shall be subject to territorial management.

If the payer has a branch in a different place, the branch shall generally apply for social insurance registration as an independent payer to the local social insurance agency.

Cross-regional payment units, their social insurance registration places shall be determined by the relevant regions through consultation. If there are different opinions, the place of registration shall be determined by the social insurance agency at the next higher level. Article 7 When applying for social insurance registration, the payer shall fill in the social insurance registration form and submit the following documents and materials:

(1) Business license, certificate of approval for establishment or other approved practice certificates;

(two) the unified code certificate of the organization issued by the state quality and technical supervision department;

(3) Other relevant documents and materials stipulated by the social insurance agencies of provinces, autonomous regions and municipalities directly under the Central Government. Eighth social insurance agencies shall immediately accept the social insurance registration form, certificates and materials provided by the payer, and complete the examination within 10 working days from the date of acceptance; Those who meet the requirements shall be registered and issued with social insurance registration certificates. Chapter III Registration of Change Article 9 When the following social insurance registration items of the payer change, it shall apply to the original social insurance registration institution for registration of change of social insurance according to law:

(a) the name of the unit;

(2) domicile or address;

(three) the legal representative or person in charge;

(4) Type of unit;

(five) the unified code of the organization;

(6) the competent department;

(7) affiliation;

(8) Bank account number;

(nine) other matters stipulated by the social insurance agencies of provinces, autonomous regions and municipalities directly under the central government. Article 10 A payer shall, within 30 days from the date when the administrative department for industry and commerce handles the change registration or the relevant departments approve or announce it, go to the original social insurance registration institution to handle the change registration of social insurance with the following documents and materials:

(1) An application for registration of change of social insurance;

(two) the registration form of industrial and commercial change and the industrial and commercial license or the certificate of approval or announcement of the change by the relevant authorities;

(3) social insurance registration certificate;

(4) Other materials stipulated by the social insurance agencies of provinces, autonomous regions and municipalities directly under the Central Government. Article 11 If the materials submitted by the entity applying for change registration are complete, the social insurance agency shall issue a social insurance change registration form, which shall be truthfully filled out by the entity applying for change registration according to law and incorporated into the payer's social insurance registration file after being audited by the social insurance agency.

If the contents of the social insurance change registration involve the contents of the social insurance registration certificate and need to be changed, the social insurance agency shall withdraw the original social insurance registration certificate and reissue the social insurance registration certificate according to the changed contents. Chapter IV Cancellation of Registration Article 12 In case of dissolution, bankruptcy, cancellation or merger of the payer, it shall timely apply to the original social insurance registration authority for cancellation of social insurance registration. Thirteenth payment units shall, within 30 days from the date of cancellation of registration by the administrative department for Industry and commerce, apply to the original social insurance registration institution for cancellation of social insurance registration; Payment units that do not need to cancel registration in the administrative department for industry and commerce according to regulations shall apply to the original social insurance registration institution for cancellation of registration of social insurance within 30 days from the date of approval or announcement of termination by the relevant authorities.

Where the business license of the payer is revoked by the administrative department for industry and commerce, it shall, within 30 days from the date of revocation of the business license, apply to the original social insurance registration institution for cancellation of registration. Article 14. If the change of residence or address of production and business operation involves the change of social insurance registration institution, the payer shall, within 30 days from the date of the above change, go through the cancellation of social insurance registration at the original social insurance registration institution and go through the social insurance registration at the social insurance agency in the place where it moves in. Fifteenth payment units shall settle the social insurance premiums, late fees and fines payable before going through the cancellation of social insurance registration.

When handling the cancellation of social insurance registration, the payer shall submit an application for cancellation of social insurance registration, legal documents or other relevant cancellation documents, and go through the formalities for cancellation of social insurance registration with the approval of the social insurance agency, and submit the social insurance registration certificate.
