The operation process of terminating employment and social security in Shanghai needs to be refined.

According to the Administrative Measures of Shanghai Municipality on Recruiting and Resignating Units (No.19), employers should establish labor relations in accordance with the law, and the units should handle the employment procedures for them. The employing unit shall, within one month from the date of employing workers, go through the employment registration formalities at the employment agency affiliated to the labor and social security department of this Municipality. When handling the employment registration formalities, the following documents should be presented: the labor manual of the employed person, the copy of the labor contract signed between the unit and the employee, and the business license. Foreign-invested enterprises are also required to produce the Registration Certificate of Labor Management of Foreign-invested Enterprises in Shanghai printed by Shanghai Labor and Social Security Bureau. If the unit has entrusted the employment agency of the labor and social security department to manage the archives, it may entrust it to handle the recruitment procedures. After the termination or rescission of the labor relationship between the unit and the employee, the resignation formalities must be handled. When going through the formalities, you should fill in the Notice of Resignation of Workers in Shanghai in triplicate, and go through the resignation formalities at the employment agency under the labor and social security department where the unit is located within two weeks from the date of termination or dissolution of labor relations. When going through resignation procedures, you should hold the following materials: Labor Manual, Notice of Resignation of Employees in Shanghai and Certificate of Payment of Unemployment Insurance Premium of Employees in Shanghai. If the unit has entrusted the employment agency of the labor and social security department to manage the files, it may entrust its agent to handle the resignation procedures.
