Huinong district social security work injury appraisal results

Work-related injury refers to an accidental injury or occupational disease suffered by an employee in the course of work due to work-related reasons. According to the provisions of Article 14 of the Regulations on Work-Related Injury Insurance, an employee shall be recognized as having suffered a work-related injury if he or she:

(1) suffers an accidental injury due to work-related causes during working hours and in the workplace;

(2) suffers an accidental injury while engaged in work-related preparatory or finishing work in the workplace before or after working hours;

(3) suffers an accidental injury due to violence or other accidental injuries while performing his or her work duties. (3) Injured by violence or other accidents during working hours and in the workplace while performing work duties;

(4) Suffering from occupational diseases;

(5) Injured due to work-related reasons or unaccounted for in accidents while away from home;

(6) Injured by traffic accidents or accidents on urban railways, passenger ferries or trains during commuting to and from work for which the employee is not primarily responsible;

(7) Injured in accidents on urban railways, passenger ferries or trains;

(8) Injured in accidents in which the employee is not primarily responsible; and

(vii) other cases which are stipulated by laws and administrative regulations to be recognized as work-related injuries.

At the same time, according to the provisions of Article 15 of the Regulations, an employee shall be deemed to have suffered a work-related injury if he or she suffers from one of the following circumstances:

(1) death from a sudden illness during working hours or at the workplace, or death within 48 hours of the failure of resuscitation;

(2) injuries sustained in the course of safeguarding the interests of the state or the public interest in rescue and relief of disasters, etc.;

( (C) the employee originally served in the military, war, service-incurred injuries caused by disability, has obtained the revolutionary disabled soldier's certificate, to the employer after the recurrence of old injuries.
