What does labor dispatch mean? Are there five insurances and one gold?

Labor dispatch is a form of employment. Labor dispatch has five risks, but not necessarily one gold.

Labor dispatch refers to a special form of employment in which labor dispatch units sign labor contracts with dispatched employees and send employees to work in the employing units. According to the Social Insurance Law of People's Republic of China (PRC), enterprises must register social insurance for employees within 30 days from the date of employment. In other words, as long as there is labor relations, enterprises must buy five insurances for workers, including medical insurance, endowment insurance, unemployment insurance, work injury insurance and maternity insurance, which is legal. "People's Republic of China (PRC) Labor Contract Law" also has corresponding provisions. When signing a labor dispatch agreement, both parties shall agree on the social security expenses of the labor dispatch personnel. As for the "one gold" in "labor dispatch has five insurances and one gold", it refers to the housing provident fund. Social insurance does not include housing accumulation fund. Enterprises can choose to buy, and labor dispatch personnel can negotiate with enterprises or labor dispatch agencies if they need it.

The labor dispatch unit shall perform the following obligations to the dispatched workers:

1. Truthfully inform the dispatched workers of the matters specified in Article 8 of the Labor Contract Law, the rules and regulations to be observed and the contents of the labor dispatch agreement;

2. Establish a training system to provide post knowledge and safety education and training to the dispatched workers;

3, according to the provisions of the state and the labor dispatch agreement, pay the labor remuneration and related treatment of the dispatched workers according to law;

4, in accordance with the provisions of the state and the labor dispatch agreement, pay social insurance premiums for the dispatched workers in accordance with the law, and go through the relevant procedures of social insurance;

5. Urge the employing unit to provide labor protection and labor safety and health conditions for the dispatched workers according to law;

6. Issue a certificate of dissolution or termination of the labor contract according to law;

7. Assist in handling disputes between dispatched employees and employers;

8. Other matters stipulated by laws, regulations and rules.

The materials required for handling five insurances and one gold are as follows:

1, the individual only needs to provide the unit with the citizen ID card and its copy, and also needs to provide a personal 1 inch color bareheaded photo;

2. The information required for unit registration is as follows:

(1) Business license, approval certificate or practice license;

(2) Organization code certificate issued by the national quality and technical supervision department;

(4) Details of salary payment in any month of the year;

(6) ID card of the legal representative;

(seven) other relevant documents and materials stipulated by the social insurance agency.

To sum up, it is in compliance with relevant laws and regulations for regular labor dispatch companies to engage in labor dispatch business. What can be clearly told to employees is that labor dispatch employees cannot be dismissed at will.

The employing unit shall, within 30 days from the date of employment, apply to the social insurance agency for social insurance registration for its employees. If the social insurance has not been registered, the social insurance agency shall verify the social insurance premium it should pay.

Labor dispatch workers have five insurances and one gold, and the laborer has signed a labor dispatch contract with the labor service company. The labor service company should pay social security and housing provident fund for the laborer according to law, otherwise the laborer can complain to the social security bureau and the housing provident fund management center where the employer is located.
