The Law of the People's Republic of China on Social Insurance

Article 45 stipulates:

Unemployed persons shall receive unemployment insurance benefits from the unemployment insurance fund if they meet the following conditions:

(1) if the employer and the unemployed person have paid unemployment insurance premiums for at least one year before becoming unemployed;

(2) if the unemployed person has If the employment is interrupted not because of one's own will;

(iii) If one has registered as unemployed and has a request to seek employment.

Article 14 of the Regulations on Unemployment Insurance

provides that:

Unemployed persons who have the following conditions may receive unemployment insurance benefits:

(1) they have participated in unemployment insurance in accordance with the regulations, and their units and themselves have fulfilled their obligations to pay contributions for one year in accordance with the regulations;

(2) they have had interruptions in employment not due to their own will;
