How does the Social Security Bureau determine the length of service?

Legal analysis: length of service refers to the length of service when you work in an employer and the employer pays you five insurances and one gold. From the first month of payment, twelve months is one year, and twelve months after payment is one year.

Legal basis: the revised draft of the Detailed Rules for the Implementation of the Labor Insurance Regulations of People's Republic of China (PRC) (Note: the provisions of this Law on maternity treatment of female employees have been abolished by the Labor Protection Regulations of female employees).

Article 38

General length of service refers to the working hours of employees whose wage income is their whole or main source of livelihood. When calculating the general length of service, it should include the length of service of the enterprise.

Article 39

The length of service of this enterprise is calculated according to the continuous working hours of employees in this enterprise. Those who leave the company shall be counted from the date of their last return to work in this enterprise. However, under any of the following circumstances, this restriction shall not apply:

A, where the enterprise management, enterprise administration or management to mobilize workers, before and after the transfer in the enterprise's length of service, should be calculated continuously. However, before liberation, the enterprise's length of service can only be calculated continuously if it needs to be transferred for business and has definite proof.

Second, the workers who worked in this enterprise before liberation and were forced to leave and return to this enterprise, if there is a definite proof, can be merged into this enterprise to calculate the length of service after being discussed and approved by the labor insurance committee.

Three, after liberation, the enterprise management organs, enterprise administration or employers to deploy domestic and foreign learners, their learning period and the length of service in the enterprise before and after the deployment, should be calculated continuously. Before liberation, the personnel transferred to study at home and abroad by the enterprise management organ, enterprise administration or employing unit, if there is a definite proof, except the length of service during the study period, the length of service of the enterprise before and after the transfer can be calculated together.

Fourth, after liberation, if the employees are transferred to other enterprises by the enterprise management organ because of the suspension or reduction of production, the length of service of the enterprises before and after the transfer should be calculated continuously. When enterprises resume work or expand production, laid-off workers will still return to enterprises, and the length of service before and after the demobilization of enterprises should be calculated together.

Five, after the transfer, reorganization or merger of enterprises, the original employees are still in the enterprise, and the length of service before and after the transfer, reorganization or merger is continuously calculated.

Six, work-related injuries during the medical period, should be regarded as the enterprise to calculate the length of service.

7. If the medical work has been stopped for less than six months due to illness or non-work-related injury, you can continue to work in this enterprise and calculate the length of service; Employees who have returned to the original enterprise after more than six months of recovery shall not calculate the length of service, except for the period of more than six months, and the length of service before and after the enterprise shall be calculated together.

Eight, under the reactionary rule of the puppet government and the Kuomintang, people who were forced to leave their jobs to resist their oppression, and those who were imprisoned by the puppet government and the Kuomintang government and continued to struggle during their resignation, before and after leaving their jobs or after being reinstated or transferred to other enterprises, the length of service of their own enterprises should be calculated continuously.
