The situations in which workers are entitled to social insurance treatment in accordance with the law: retirement; illness or injury; work-related disability or occupational disease; unemployment; and maternity. China's workers enjoy the following benefits: retirement pension insurance benefits; illness and injury insurance benefits; work-related injuries insurance benefits; unemployment insurance benefits; maternity insurance benefits. There are also survivor's benefits for the survivors of workers who die.

Legal Basis

Article 36 of the Social Insurance Law of the People's Republic of China

If a worker is injured in an accident or suffers from an occupational disease as a result of work, and is recognized as having suffered an occupational injury, he shall be entitled to the benefits of occupational injury insurance; and if he loses the ability to work after the appraisal of his labor capacity, he shall be entitled to the benefits of disability.

Identification of work-related injuries and appraisal of labor capacity shall be simple and convenient.

Article 54

Where an employer has paid maternity insurance premiums, its employees shall be entitled to maternity insurance treatment; and the unemployed spouse of an employee shall be entitled to maternity medical expenses treatment in accordance with State regulations. The necessary funds shall be paid from the Maternity Insurance Fund.

Maternity insurance benefits include maternity medical expenses and maternity allowance.
