Legal basis: Article 104 of the Basic Medical Care and Health Promotion Law of People's Republic of China (PRC) violates the provisions of this law. If the basic medical insurance agencies, medical institutions and drug trading units defraud the basic medical insurance benefits by fraud, forgery of certification materials or other means, or defraud the basic medical insurance fund by fraud, forgery of certification materials or other means, the medical security department of the people's government at or above the county level shall impose administrative penalties in accordance with the provisions of social insurance laws and administrative regulations.
