Whether the dispute over social security contributions is a labor dispute

Social security fee disputes are disputes between employers and workers, which are labor disputes. The following disputes between employers and workers are labor disputes: disputes over working hours, rest and vacation, social insurance, welfare, training, and labor protection; disputes over the conclusion, performance, alteration, dissolution, and termination of labor contracts; disputes over removal, dismissal, and resignation, and separation; and others.

Legal Basis

Article 2 of the Law of the People's Republic of China on Mediation and Arbitration of Labor Disputes in the People's Republic of China

This Law shall be applicable to the following labor disputes between employers and laborers within the territory of the People's Republic of China:

(1) Disputes over the confirmation of labor relations;

(b) Disputes arising from the conclusion, fulfillment, alteration, dissolution and termination of labor contracts;

(c) Disputes arising from removal, dismissal and resignation, and separation from service;

(d) Disputes arising from working hours, rest and vacation, social insurance, benefits, training and labor protection;

(e) Disputes arising from remuneration for labor, medical fees for work-related injuries, and economic indemnities or compensations

(vi) other labor disputes stipulated by laws and regulations.
