Voluntary waiver of social security agreement

Voluntary abandonment of social security agreement is one of the means adopted by enterprises in order to save expenses and maximize benefits. However, it should be noted that paying social security for employees is a legal obligation of enterprises, and rights can be waived and obligations must be fulfilled. This is the basic principle of law. Therefore, it is an invalid legal act for an enterprise to ask employees to sign a letter of guarantee to give up the social security purchased by the unit for themselves.

Legal basis:

Article 72 of the Labor Law of People's Republic of China (PRC) determines the sources of social insurance funds according to the types of insurance, and gradually implements social co-ordination. Employers and workers must participate in social insurance and pay social insurance premiums according to law.
