Article 2 These Measures shall apply to all persons, including migrant workers, who participate in the basic pension insurance for urban enterprise employees. Article 3 If an insured person is employed across provinces, the social insurance agency (hereinafter referred to as the social insurance agency) in the place where the insured person was originally enrolled shall issue a certificate of participation and payment of contributions, and his/her basic old-age insurance relationship shall be transferred to the new place where he/she is enrolled. Article 5 The transfer of the basic pension insurance relationship of the insured person's cross-provincial mobile employment shall be handled in accordance with the following provisions:

(1) If the insured person returns to the place of his domicile (provinces, autonomous regions and municipalities directly under the central government, hereinafter referred to as the same) for the employment of the insured person, the social security agency of the place of his domicile shall handle the transfer of the procedures in a timely manner for him.

(2) If the insured person does not return to his place of domicile for employment and insurance, the social security agency in the new place of insurance shall handle the transfer and continuity procedures for him in a timely manner. Article 6: When an insured person who is employed across provinces reaches the conditions for entitlement, the place of entitlement shall be determined in accordance with the following provisions:

(1) If the basic old-age insurance relationship is in the place of domicile, the place of domicile shall be responsible for handling the entitlement formalities, and the person shall be entitled to the basic old-age insurance entitlements.

(2) If the basic pension insurance relationship is not in the place of household registration, but the accumulated contribution period in the place of his/her basic pension insurance relationship is 10 years, he/she will go through the entitlement procedures in that place, and enjoy the local basic pension insurance treatment.

(3) If the basic pension insurance relationship is not in the place of domicile and the accumulated contribution period in the place of the basic pension insurance relationship is less than 10 years, the basic pension insurance relationship will be transferred back to the original place of participation where the last contribution period of 10 years was completed to complete the entitlement formalities and enjoy the basic pension insurance benefits.

Article 7 After the transfer of the insured person to continue the basic pension insurance relationship, meet the conditions for entitlement, in accordance with the provisions of the "State Council's Decision on Improving the Basic Pension Insurance System for Enterprise Employees" (Guofa 〔2005〕 No. 38), the basic pension is calculated on the basis of the person's annual wages, years of contribution, and the average wage of the employees on the job in the place of entitlement in each corresponding year.

Article 8 In case of inter-provincial mobility of insured persons for employment, the following procedures shall be followed for the transfer and continuity of basic pension insurance relations:

(1) After the insured person establishes the basic pension insurance relations and pays the contributions in accordance with the regulations in the new place of employment, the employing unit or the insured person submits a written application for the transfer and continuity of the basic pension insurance relations to the social security agency in the new place of employment.

(2) Within 15 working days, the social security agency of the new place of participation shall examine the application for transfer and continuity, and if it meets the conditions stipulated in these Measures, it shall issue a letter of consent to accept the application to the social security agency of the place where the insured person's original basic old-age insurance relationship is located and provide the relevant information; and if it fails to meet the conditions for transfer and continuity, it shall give a written explanation to the applying unit or the insured person.

(3) Within 15 working days after receiving the letter of acceptance, the social security agency in the place where the original basic pension insurance relationship is located shall handle the formalities for the transfer and continuity.

(d) Upon receiving the transfer of the basic pension insurance relationship and funds from the social security agency in the place where the participant's original basic pension insurance relationship is located, the social security agency in the new place of participation shall complete the relevant formalities within 15 working days, and promptly notify the employer or the participant of the confirmation.

Article 9 If a rural migrant worker interrupts his employment or returns to his hometown and does not continue to make contributions, the social security agency in the place where he was originally insured shall retain his basic pension insurance relationship, keep all his records of participation and contributions as well as his personal account, and the amount of the stored funds in his personal account shall continue to accrue interest in accordance with the regulations. If a rural migrant worker returns to the town for employment and continues to participate in the insurance premiums, regardless of whether he/she returns to his/her original place of participation for employment or goes to other towns for employment, he/she shall accumulate his/her years of contributions according to the aforesaid provisions, and calculate the amount of his/her individual account storage together, and if he/she meets the conditions for receiving the treatment, he/she shall enjoy the same basic pension insurance treatment as the urban workers; if a rural migrant worker does not return to the town for employment, his/her records of participation in the insurance premiums and his/her individual account shall be valid in full and According to the actual situation of the rural migrant workers, or when they meet the required conditions for receiving the basic pension insurance treatment of urban workers, or transferred to the new rural social pension insurance.

Accelerate the establishment of a nationally unified basic pension insurance participation and contribution information query service system, and issue a nationally common social security card to provide convenient and effective technical services for participants to query the participation and contribution information.

Article 11 Where the policies relating to the transfer and continuity of basic pension insurance relations across provinces that have been formulated by local governments are inconsistent with the provisions of these Measures, the provisions of these Measures shall prevail. Measures for the transfer and continuity of basic pension insurance relations within provinces, autonomous regions and municipalities directly under the central government shall be formulated by the people's governments at the provincial level with reference to these Measures and reported to the Ministry of Human Resources and Social Security for the record.

Article 12 The contribution period referred to in these Measures includes the deemed contribution period unless otherwise specified.
