1. The state has corresponding provisions on the old-age insurance for criminals. If an employee is sentenced or reeducation through labor, his personal account shall be kept by the social insurance agency during the period of serving his sentence or reeducation through labor, and interest shall continue to be calculated at the bookkeeping rate; After reaching the statutory retirement age, the personal account amount will bear interest according to the bank's savings deposit rate for urban and rural residents in the same period.

2. Employees who have been sentenced or re-educated through labor and have been released after the statutory retirement age, where the "middleman" has paid 10 years and the "newcomer" has paid 15 years, can go through retirement procedures and receive basic pensions, including basic pensions, on a monthly basis; If the payment period of "middle person" is less than 10 year, and that of "new person" is less than 15 year, all the savings in his personal account will be paid to him in one lump sum, and the basic old-age insurance relationship will be terminated.

3. Employees who are sentenced or re-educated after retirement will not enjoy the basic old-age insurance benefits during their prison sentences and re-education through labor; The basic pension after the expiration of the restoration of political rights or reeducation through labor shall be paid according to the standards before serving the sentence and reeducation through labor, and then adjusted normally according to the regulations. Retirees who have been sentenced to fixed-term imprisonment with probation and have not been deprived of political rights can continue to enjoy the basic old-age insurance benefits, and the basic pension will not be adjusted during the probation period.

Article 25 of the Labor Law stipulates that the employer may terminate the labor contract under any of the following circumstances:
