Chapter II Protection Objects and Identification Procedures
Article 4 The object of protection: within the administrative area of Ganzhou City, with legal approval, all or most of the rural collective land has been lost due to the unified expropriation of rural collective land by the municipal and county governments (the per capita contracted arable land area after land acquisition is less than 0.3 mu), and the registered agricultural population at the time of land acquisition is over 16 years old. Article 6 After the implementation of these Measures, the procedures for newly identifying landless farmers are as follows:
(a) the identity of landless farmers by the village (neighborhood) committee of first instance;

If there is any objection to the qualification of the security object, the township (town) government and the sub-district office shall investigate and verify it in time, and publicize the results of the investigation in the place where the personnel who have objections to the qualification of the security object are located. Seventh after the implementation of these measures, the newly identified landless farmers need to provide materials to apply for insurance:

Article 10 After the implementation of these measures, if the newly recognized landless farmers choose to participate in the basic old-age insurance for employees, the payment base shall be approved according to 60% of the average monthly salary of employees in Jiangxi Province last year when they participate in the insurance, with the payment ratio of 20%; The subsidy for insurance payment given by the government is used for the social pooling expenses that should be paid during the subsidy period of landless farmers and is included in the social pooling fund; Individuals pay the basic old-age insurance premium at the rate of 8% during the period of enjoying the insurance premium subsidy, and record it in their personal accounts according to the regulations; If the payment period reaches 15 years, reaching 60 years for men and 55 years for women, they will apply for a basic pension and receive it from the month after approval. (1) If the male is under 45 years of age and the female is under 40 years of age at the time of enrollment, 60% of the average monthly salary of employees in Jiangxi Province in the previous year will be used as the payment base, and 8% of the basic old-age insurance premium will be paid year by year. The corresponding annual basic old-age insurance premium 12% is deducted from the insured payment subsidy year by year until the insured payment subsidy is deducted, and individuals begin to pay in full according to the basic old-age insurance payment regulations for flexible employees.

Article 11 After the implementation of these Measures, if the newly recognized landless peasants choose to participate in the insurance according to the basic old-age insurance for urban and rural residents, the urban and rural residential insurance agencies shall register their participation, establish personal accounts, increase the old-age insurance payment subsidies for landless peasants in their personal accounts, and record the payment subsidies.
(a) for landless farmers who have participated in the basic old-age insurance for urban and rural residents, but have not reached the age of receiving treatment, the subsidy for insurance payment will be directly included in their personal accounts, and the basic old-age insurance premium will continue to be paid according to regulations. (two) the landless farmers who have received the basic old-age insurance for urban and rural residents will be included in their personal accounts at one time, and the personal account pension will be issued in accordance with the regulations from the next month;
(three) the death of the landless peasants, the balance of the insured payment subsidies in the individual accounts of the landless peasants can be inherited according to law. Government subsidies to landless farmers are not converted into the payment period of basic old-age insurance for urban and rural residents.
Twelfth after the implementation of these measures, the newly recognized landless farmers choose to participate in the basic old-age insurance for employees or the basic old-age insurance for urban and rural residents. After reaching the statutory retirement age of employees' basic old-age insurance, if it is necessary to handle the convergence of urban and rural old-age insurance systems, it shall be implemented in accordance with the national and provincial policies and regulations on the convergence of urban and rural old-age insurance systems.
Thirteenth after the implementation of these measures, the newly identified landless farmers are active servicemen, students and employees, and their insurance and subsidies are as follows:
(a) the landless peasants are active servicemen and do not participate in the old-age insurance for landless peasants during their service. Retired from active service and insured as an individual, you can participate in the basic old-age insurance in accordance with the provisions of these measures and enjoy the subsidy for insurance payment;
(two) landless peasants are students in school, did not participate in the old-age insurance for landless peasants during school, and after graduation, they can participate in the basic old-age insurance according to the provisions of these measures and enjoy the insurance payment subsidies;
(3) If the landless peasants are employed by the unit and have been insured, they will not participate in the old-age insurance for landless peasants during the employment insurance period, and if they are insured as individuals after unemployment, they can participate in the basic old-age insurance according to the provisions of these Measures and enjoy the subsidy for insurance payment.
The landless peasants mentioned in this article, who choose to participate in the basic old-age insurance in accordance with these measures within one year after retiring from active service, graduating from school or being unemployed, enjoy full insurance payment subsidies; Overdue insured according to the provisions of article ninth of these measures to calculate the number of overdue months and insurance payment subsidies.
Article 14 Counties (cities, districts) shall, in light of local conditions, refer to the subsidy standards and payment methods stipulated in these Measures, and in accordance with the principle of smooth transition, allow land-expropriated farmers who have been identified before the implementation of these Measures to participate in the insurance policy for land-expropriated farmers at that time, and those who have been identified as land-expropriated farmers and have received old-age subsidies before the implementation of these Measures to change into basic old-age insurance for employees:

(two) before the implementation of these measures has been identified as landless farmers and have received pension subsidies:

Chapter IV Fund Raising and Management
Article 16 The financial department shall set up a special financial account for the social security funds of landless farmers, which is mainly used for the insurance payment subsidies needed for the old-age security of landless farmers. Funds are raised through the following channels:
(a) 8% of the proceeds from the transfer of state-owned land;
(two) the superior and local financial subsidies;
(three) land units to pay;
(4) others.
Article 17 Before the implementation of these measures, if the landless peasants who have been identified fail to participate in the insurance policy for landless peasants at that time, and if they have been identified and received pension subsidies before the implementation of these measures, the subsidy funds for insurance payment given by the government at the time of enrollment shall be solved by the financial department of the county (city, district) from the balance of social security funds for landless peasants raised over the years; The insufficient part will be solved from 20 15 by deducting the surplus funds of the social security fund of the landless peasants from the newly recognized insurance payment subsidies of the landless peasants in that year.

Counties (cities, districts) where the problem of old-age security for land-expropriated farmers is relatively concentrated and the funding gap is relatively large should appropriately increase the proportion of social security funds for land-expropriated farmers in the land transfer income on the basis of the proportion specified in Document No.20 [2007] of the State Council Office.
Article 18 After the implementation of these Measures, counties (cities, districts) shall, in the process of land acquisition, treat the basic old-age insurance subsidies for landless farmers as land acquisition expenses in strict accordance with the requirements of "Opinions of the State Council on Strengthening Land Regulation and Control" (Guo Fa [2006] No.31). Formulate the implementation plan of the basic old-age insurance payment subsidy for land-expropriated farmers, clarify the list of subsidy objects, standards and ways to raise funds, and ensure that within three months after the approval of the land acquisition compensation and resettlement plan, the insurance payment subsidy funds will be fully allocated to the financial special account of the social security fund in accordance with the regulations.
Nineteenth land acquisition farmers resettlement subsidies and land acquisition compensation should give priority to their individual contributions to participate in the basic old-age insurance. Where the collective economy develops well, the collective can appropriately bear part of individual contributions. If it is difficult for individual landless farmers to pay fees, local governments are encouraged to explore ways to solve them, such as bank loans, government interest subsidies, and partial pension repayment.
Chapter V Organization and Management

The human resources and social security department is responsible for the overall planning, policy formulation, organization, implementation and management of the insured land-expropriated farmers; The financial department is responsible for the extraction of social security funds for landless farmers, the collection of payment subsidies, the budget arrangement of working funds and the audit, supervision and management of the use of funds; Land and resources, agriculture, food and other departments are responsible for land acquisition, land acquisition compensation and the identification of landless farmers, cooperate with the financial department to raise subsidies for basic old-age insurance for landless farmers, and review the implementation of basic old-age insurance for landless farmers in conjunction with the human and social departments; The audit department shall, in accordance with its duties, supervise the collection, management and use of subsidies for basic old-age insurance for landless farmers; The civil affairs department is responsible for the minimum living security and social assistance for landless farmers.

Article 22 After the implementation of these Measures, counties (cities, districts) shall, when organizing the examination and approval of land use, calculate the subsidy funds for participating in the basic old-age insurance for land-expropriated farmers according to the scale of the land to be requisitioned, the number of people to be guaranteed (calculated by dividing the area of cultivated land to be requisitioned by the per capita cultivated land area of the collective economic organizations of the land-expropriated villages before land acquisition) and the subsidy standards, and the land-expropriated units shall deposit them into the escrow account of the human resources and social security department of the county (city, district) in state-owned or state-controlled commercial banks in advance. The local government shall be responsible for the pre-storage of batch construction land and single site construction land provided by land transfer. Chapter VI Supplementary Provisions

Twenty-fifth after the implementation of these measures, the newly recognized landless farmers can apply for the basic old-age insurance for employees or the basic old-age insurance for urban and rural residents after obtaining the landless farmers' certificate, and go through the insurance payment procedures within the prescribed time limit. Before the implementation of these measures, those who have been identified as landless farmers and have not been insured according to the insurance policies of landless farmers in the counties (cities, districts) at that time, and those who have been identified as landless farmers and have received old-age subsidies before the implementation of these measures must participate in and change the basic old-age insurance for employees before 20 15 10.
Twenty-sixth counties (cities, districts) shall formulate detailed rules for the implementation of the basic old-age insurance for landless farmers according to these measures, and shall not replace the social security for landless farmers with the basic old-age insurance for urban and rural residents. Before the implementation of the detailed rules for the implementation of the basic old-age insurance for landless farmers, counties (cities, districts) should be reported to Ganzhou Human Resources and Social Security Bureau for the record. Before the promulgation of these measures, the policies of landless farmers formulated and implemented by counties (cities, districts) should be reasonably linked with these measures to achieve a smooth transition.
Article 27 These Measures shall come into force as of the date of promulgation. Where the previous provisions are inconsistent with these Measures, these Measures shall prevail. In the future, if it is inconsistent with the policies promulgated by the state and province, it shall be implemented according to the relevant policies of the state and province. The specific issues in the implementation of these Measures shall be interpreted by Ganzhou Municipal Bureau of Human Resources and Social Security, Bureau of Land and Resources and Finance Bureau.
