Do I need to pay social security for part-time jobs?

Legal analysis: if an enterprise recruits part-time employees, it does not need to pay social security if it is a labor relationship; If it is a labor relationship, whether and how to apply for social security depends on the different types of labor relations.

Legal basis: Part-time employees mainly include: part-time employees, labor dispatch employees, employees with special labor relations, etc.

1, part-time employee

According to the Opinions of the Ministry of Labor and Social Security on Some Issues Concerning Part-time Employment issued and implemented on May 30, 2003, part-time employees can pay endowment insurance and medical insurance by themselves, and employers should only pay work-related injury insurance for them.

Part-time employers fail to apply for work-related injury insurance for part-time employees, and if part-time employees have work-related accidents in their own units, they still enjoy work-related injury insurance benefits according to law.

2. Labor dispatch employees

According to the Interim Provisions on Labor Dispatch, the dispatched employee enters into a labor contract with the labor dispatch unit, and the labor dispatch unit pays the social insurance premium for the dispatched employee and goes through the social security related procedures. The labor dispatch unit shall bear the responsibility of work-related injury insurance, but it may agree with the employer on compensation measures.

3. Employees with special labor relations

If there is a labor dispute between the employer and the employees who enjoy the pension insurance benefits or receive the pension according to law, the people's court shall handle it according to the labor relations; The people's court shall handle labor disputes with new employers due to reasons such as employees leaving their jobs without pay, not reaching the statutory retirement age, being laid off and waiting for jobs, and enterprises stopping production and taking holidays.
