Legal Objective:

Article 2 of the Social Insurance Law of the People's Republic of China*** and the People's Republic of China (PRC) states that the state establishes a social insurance system of basic old-age insurance, basic medical insurance, work-related injury insurance, unemployment insurance and maternity insurance, and guarantees the right of citizens to obtain material assistance from the state and society in accordance with the law in the event of old age, sickness, work-related injury, unemployment and maternity, among other circumstances. Article 58 of the Law of the People's Republic of China on Social Insurance stipulates that employers shall, within 30 days from the date of employment, apply for social insurance registration with the social insurance administration organization for their employees. If it fails to register for social insurance, the social insurance agency shall authorize the social insurance contributions to be paid. Voluntary participation in social insurance for individual business households without employees, part-time workers who do not participate in social insurance in the employer, and other flexible employment shall apply to the social insurance agency for social insurance registration.
