What procedures and materials are needed for marriage registration?

The marriage registration process is roughly as follows:

(1) application

Those who meet the requirements for marriage registration, bring relevant certification materials and registration photos, apply for marriage registration at the marriage registration office where one party's household registration is located, and fill in the application registration statement according to the guidance of the staff.

The proof materials needed to apply for marriage registration depend on individual circumstances. For example, when applying for marriage registration in China, China citizens need to hold their own identity certificate, household registration certificate, marriage examination certificate, proof of no spouse, and a signed statement that they have no direct blood relationship with each other and collateral blood relationship within three generations. If it is a divorce, you also need to bring divorce papers.

Foreigners (including foreigners residing or temporarily residing in China, overseas Chinese and foreigners residing in China) applying for marriage in China must hold their valid passports, foreigners' residence permits or temporary entry and residence certificates, and documents that can effectively prove their marital status.

(2) Review

The marriage registration authority shall verify and examine the parties who apply for marriage registration, and find out whether the documents and certificates meet the conditions for marriage. If there is any ambiguity, the marriage registration authority will generally ask the parties and ask them to provide relevant certification materials when necessary.

(3) Registration and licensing

The marriage registration office will register eligible couples and then issue marriage certificates; For divorced people who want to remarry, the marriage registration office will cancel their divorce certificates; If necessary, a written statement will be issued to those who do not meet the conditions for marriage registration, explaining the reasons for not registering.

What procedures and documents do you need for divorce?

The divorce registration process is as follows:

(1) application

If the husband and wife voluntarily divorce, they shall sign a written divorce agreement, apply to the marriage registration authority (which has jurisdiction), and provide the following application materials as required:

1. Marriage certificate issued by the Mainland Marriage Registry or Chinese embassies and consulates abroad;

2. Valid and compliant identification documents, such as household registration book, ID card, pass or passport;

3. An application for divorce registration filled in at the marriage registration office.

(2) Accept

The staff will conduct a preliminary examination of the materials provided by the parties in accordance with the regulations. After the marriage registrar checks the documents and supporting materials submitted by the parties for the first time, the parties will receive a "Receipt for Accepting the Application for Divorce Registration". If there are differences with the application conditions for divorce registration, it will not be accepted, and the parties may request to issue a notice of rejection of the application for divorce registration.

(3) cooling-off period

Within 30 days from the date when the marriage registration office receives the application for divorce registration and issues a receipt for accepting the application for divorce registration to the parties concerned, any party who does not want to divorce can bring his valid identity certificate and the receipt for accepting the application for divorce registration (the situation can be explained in writing if the receipt is lost), request the marriage registration office that accepts the application for divorce registration to withdraw the application for divorce registration, and fill out the application for withdrawal of divorce registration in accordance with the relevant provisions on the application for divorce registration. After verification by the marriage registration authority, a Confirmation Letter for Withdrawing the Application for Divorce Registration will be issued. Within 30 days after the expiration of the cooling-off period for divorce, if both parties fail to apply to the marriage registration authority for issuing a divorce certificate, the application for divorce registration shall be deemed to have been withdrawn.

(4) Review

Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the cooling-off period is a holiday, the first day after the holiday is the expiration date), divorced couples should bring valid certificates and materials, such as photos, marriage certificates, identity cards or passports, divorce agreements, etc. And apply to the marriage registration authority for a divorce certificate. The marriage registration authority shall conduct the examination in accordance with the procedures and conditions stipulated in the Code for Marriage Registration. Parties who do not meet the conditions for divorce registration shall not be dealt with. If a party requests to issue a notice not to register for divorce, the marriage registration authority shall issue it.

(5) Registration and issuance of divorce certificates
