Regulations of Yunnan Province on the Administration of Security Services

Chapter I General Provisions Article 1 These Regulations are formulated for the purpose of strengthening the management of security service organizations and security personnel, improving the quality of security service, promoting the development of security service industry and maintaining social order. Article 2 The establishment of security service organizations within the administrative region of this province, the recruitment and employment of security personnel and the engagement in security service activities must abide by these regulations. Article 3 The security service organizations mentioned in these Regulations are divided into the following two categories:

(1) Social security service organizations refer to enterprises that are approved by public security organs and registered in the administrative department for industry and commerce according to law, and provide paid security services such as guards and escorts.

(2) Internal security service organizations: refers to organizations established by enterprises and institutions with the approval of public security organs to engage in internal security, escort and other public security prevention work.

The term "security personnel" as mentioned in these Regulations refers to the personnel engaged in security services in enterprises and institutions that are employed by social security service organizations or set up internal security service organizations. Article 4 To engage in security services, we must abide by laws and regulations, and safeguard national interests, social interests and the legitimate rights and interests of citizens. Article 5 The public security organ is the competent authority of the security service industry. Public security organs at all levels shall exercise supervision, management and operational guidance over the security service organizations and their security personnel within their respective jurisdictions.

Industry and commerce, taxation, labor, price and other departments shall, in accordance with their respective responsibilities, cooperate with the public security organs to strengthen the management of social security service organizations. Chapter II Establishment of Security Service Organizations and Recruitment of Security Personnel Article 6 The city where the people's government at or above the county level is located may establish social security service organizations as needed.

The management institutions of star-rated hotels, scenic spots above the provincial level, nature reserves and development zones and other enterprises and institutions that really need to set up internal security service organizations may set up internal security service organizations.

If a unit that has not established an internal security service organization needs to use security personnel, it shall be hired from a social security service organization. Article 7 The establishment of a security service organization shall meet the following conditions:

(a) the person in charge of the security service organization is familiar with the security business and has corresponding legal knowledge;

(2) Having the articles of association of the social security service organization or the internal security service organization management system recognized by the public security organ;

(3) Other conditions stipulated by laws and regulations. Article 8 To establish a social security service organization, an application shall be submitted to the local county-level public security organ, which shall be examined by the prefecture-level and municipal public security organs, approved by the provincial public security department, issued with the Social Security Service License of Yunnan Province, and registered with the local administrative department for industry and commerce according to law before engaging in security services.

The establishment of an internal security service organization shall apply to the local public security organ at the county level, report to the local, state and municipal public security organs for approval, and issue the "Yunnan Province Internal Security Service License" before engaging in security services. Article 9 Security personnel must meet the following conditions:

(a) good conduct, voluntary participation in security work;

(2) At the time of recruitment 18 to 45 years old;

(3) Being healthy and competent for security work;

(4) Having a junior high school education or above;

(five) have the necessary legal knowledge, safety business knowledge and skills.

Those who have received public security detention, reeducation through labor or criminal punishment shall not serve as security personnel. Article 10 The recruitment of security personnel shall be conducted in public. Under the same conditions, priority shall be given to the recruitment of demobilized and retired personnel of the army and the armed police force.

The security personnel recruited must be approved by the local police station where the household registration is located or where they live temporarily. Eleventh recruited security personnel must participate in pre-job training, after the examination of the public security organs at or above the county level, and obtain the certificate of security personnel, they are allowed to take up their posts.

On-the-job security personnel must participate in the required security business training.

Pre-job training and on-the-job training of security personnel shall be organized and implemented by local public security organs at or above the county level, and may also be entrusted to public security colleges or qualified social security service organizations and other units for implementation.

The time, content and methods of security personnel training shall be stipulated separately by the provincial public security department. Article 12 Social security service organizations and units that set up internal security service organizations shall sign labor contracts with recruited security personnel in accordance with relevant state regulations.

Social security service organizations and units that set up internal security service organizations shall participate in social insurance in accordance with relevant state regulations. Personal accident insurance can be provided for security personnel as required. Chapter III Duties of Security Service Organizations and Security Personnel Article 13 Duties of Security Service Organizations:

(a) to carry out security service activities in accordance with the law, maintain the public order of customers or units, and prevent and stop illegal and criminal activities;

(two) the management of security personnel, safeguard the legitimate rights and interests of security personnel;

(3) Other duties as prescribed by laws and regulations. Article 14 Responsibilities of security personnel:

(1) Performing security tasks such as guarding and escorting according to law;

(two) to protect the scene of criminal and public security cases in the area of responsibility, and to assist the public security organs in maintaining order at the scene;

(three) in accordance with the relevant provisions, check the documents of personnel entering and leaving the duty area and the procedures for the entry and exit of vehicles and articles;

(four) to do a good job in fire prevention, theft prevention, explosion prevention and safety accident prevention in the area of responsibility;

(five) other duties as prescribed by laws and regulations.

When security personnel find criminals while performing their duties, they shall promptly hand them over to public security organs or security organizations for handling; Found unsafe hidden dangers should be eliminated in time, can not be eliminated, timely report.
