In order to further improve the basic old-age security system for land-expropriated farmers in our city, in accordance with the overall requirements of promoting the construction of urban and rural social security system as a whole, adhere to the principles of full coverage, basic security, multi-level and sustainability, and focus on increasing fairness, adapting to mobility and ensuring sustainability, land-expropriated farmers will be included in the current basic old-age insurance system. According to the Land Management Law of the State (the second draft of the amendment) and the Measures for Compensation and Resettlement of Collective Land Expropriation in Maanshan City revised by the municipal government (Decree No.48 of the municipal government) and other relevant provisions, our bureau drafted the Interim Measures for Basic Old-age Security for Land-expropriated Farmers in Maanshan City (draft for review) (hereinafter referred to as the Interim Measures). The relevant situation is now explained as follows:

I. Drafting background

The current Interim Measures for Basic Old-age Security for Land-expropriated Farmers in Maanshan City (Ma Zheng [2005] 14) has been implemented since May 1 2005, which has played a positive role in ensuring the basic livelihood of land-expropriated farmers in our city, promoting land acquisition and demolition, and maintaining social stability. At present, 88,900 farmers whose land has been expropriated have participated in insurance, of which 26,500 have been paid. In the process of implementation, due to the changes in the superior law, guarantee methods, fund raising channels and other issues, it should be re-formulated. Mainly based on the following two aspects:

(1) The forthcoming national land management law stipulates that local governments should bring landless farmers into the corresponding social security system. The province will introduce the old-age security policy for landless farmers, and the policy of our city needs to be revised to keep consistent with its regulations.

(2) Article 15 of Decree No.48 of the municipal government requires that the measures for raising social security funds for landless farmers shall be formulated separately by the municipal government.

In order to implement the spirit of the superior documents, combined with the actual situation of our city, our bureau drafted the Interim Measures for the Basic Old-age Security for Landless Farmers in Maanshan City (Draft for Review).

Second, the main content

Article *** 16 of the Measures mainly includes the scope of protection, fund raising, account setting, enrollment process, protection methods and rights protection.

(1) protection scope. Where the land-expropriated farmers who have reached the age of 16 or above at the time of land expropriation in the municipal area of this Municipality, those who did not participate in the basic old-age insurance for urban workers before the implementation of Decree No.48 of the municipal government shall be included in the basic old-age insurance for land-expropriated farmers; According to Decree No.48 of the municipal government (excluding land-expropriated farmers who have been expropriated in the past and have been included in the basic old-age security for land-expropriated farmers), a payment subsidy account is established and payment subsidies are given. I will choose to participate in the basic endowment insurance for urban workers or the basic endowment insurance for urban and rural residents.

(2) fund raising. The establishment of the basic old-age security fund for land-expropriated farmers, composed of pooling funds and individual account funds, is included in the financial accounts. As a whole, the fund will charge 50,000 yuan per mu according to the land area to be expropriated, which will be paid by the land acquisition entity. Individual account funds are composed of individual contributions and their interest. Land-expropriated farmers who have participated in the old-age security before the implementation of Decree No.48 of the municipal government can voluntarily choose one of the payment standards of 6000 yuan and 9000 yuan. After the implementation of Decree No.48 of the municipal government, the payment amount of landless farmers participating in the old-age security shall be determined by themselves. Individual contributions need to be paid in one lump sum.

(3) Subsidy account setting. After the implementation of Decree No.48 of the municipal government, the landless farmers who participated in the old-age security will be included in the payment subsidy account by the municipal social insurance agency according to the age and subsidy standard of the old-age security personnel at the time of land acquisition. Specific criteria: 16 years old to 34 women, 39 men and 20,000 yuan subsidy; A subsidy of 25,000 yuan for women aged 35, men aged 40 to women aged 39 and men aged 44; 40 women, 45 men and 49 women are subsidized by 30,000 yuan; 45 women and 50 men subsidize 35,000 yuan for 49 women and 54 men; Women over 50 years old, men over 55 years old subsidy of 40 thousand yuan.

(4) Insurance process. Land-expropriated farmers who meet the requirements for participating in the old-age security shall be uniformly collected by the villagers' committee at the place where the land is expropriated, and the relevant certification materials such as the ID card and household register of the land-expropriated farmers approved by the municipal natural resources and planning department, and fill in the Registration Form of the Land-expropriated farmers participating in the basic old-age security, which shall be audited by the township (street) labor security office, rechecked by the district human resources and social security department, confirmed by the municipal social insurance agency, and go through the registration formalities for participating in the old-age security.

(5) Guarantee method. "Interim Measures" changed the single security mode of Ma Zheng [2005] 14 document in our city into two security modes to realize a gradual transition, that is, the farmers whose land was expropriated and insured continued to implement Ma Zheng [2005] 14 document before the municipal government issued Decree No.48; In accordance with Decree No.48 of the municipal government, newly-added landless farmers will be included in the basic old-age insurance for urban workers or urban and rural residents by giving payment subsidies. That is, before the implementation of Decree No.48 of the municipal government, farmers whose land has been expropriated will participate in the old-age security, and they will receive the old-age security fund from the next month when women reach the age of 55 and men reach the age of 60; Those who have reached and exceeded the above-mentioned age and have not registered in the municipal social insurance agency will be issued with the old-age security fund from the second month of participating in the old-age security registration.

When land-expropriated farmers who implement land expropriation according to Decree No.48 of the municipal government reach the legal age of receiving old-age insurance, they will transfer the funds from their subsidy accounts and personal accounts to their personal accounts of basic old-age insurance for urban and rural residents in one lump sum, and plan and pay account pensions according to the basic old-age insurance benefits for urban and rural residents; Participate in the basic old-age insurance for urban workers, and pay the funds in the subsidy account and personal account to me in one lump sum.

(6) safeguarding rights and interests. The basic old-age security funds and payment subsidies for landless farmers are paid from the overall fund, and the insufficient part is borne by the municipal finance. The individual account guarantee fund is paid from the individual account fund. After the individual account fund is paid, it will be paid from the overall fund. After the death of the landless peasants, the balance in the personal account and the payment subsidy account shall be paid to the legal heir or designated beneficiary in one lump sum.

Those who die during the period of receiving the basic old-age security benefits for landless farmers will be given funeral expenses and one-time difficult subsidies. If there is no designated beneficiary or legal heir, no one-time hardship allowance will be issued. The standard of funeral expenses is 2000 yuan per person; The standard of one-time hardship allowance is the old-age security fund for the eight months before the death.

At the same time, those who die while enjoying the basic old-age security for land-expropriated farmers and the basic old-age insurance for urban and rural residents will be paid a one-time subsidy from the basic old-age security fund for land-expropriated farmers according to the higher standards of the basic old-age security for land-expropriated farmers and the basic old-age insurance for urban and rural residents.

Third, implementation.

This year is the first year of the implementation of the Interim Measures, with new contents and great policy changes. In the next step, our bureau will, together with the Municipal Bureau of Resources and Planning and the Municipal Finance Bureau, seriously organize the implementation to ensure the smooth progress of the basic old-age security for landless farmers in our city.

First, the urban areas will issue interim measures as soon as possible to clarify the responsibilities and specific requirements undertaken by all levels.

The second is to strengthen publicity and training, so that all managers can unify their thinking and understanding, understand the specific contents and operational norms of the Interim Measures, and actively carry out policy propaganda to create conditions for the smooth implementation of the Measures.

The third is to guide hanshan county, Hexian, dangtu county and Zhengpugang New Districts to formulate old-age security measures for landless peasants according to the actual situation.
