Regulations of Panjin Municipality on Funeral Management

Chapter I General Provisions Article 1 In order to strengthen funeral management, promote funeral reform, protect and save land resources, and promote the construction of socialist spiritual civilization and ecological civilization, these Regulations are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to funeral activities and their management within the administrative area of this Municipality.

Respect the funeral customs of ethnic minorities; Voluntary reform of funeral customs, others shall not interfere.

Other provisions of the state and province shall apply to the funeral activities and management of Hong Kong, Macao and Taiwan residents, overseas Chinese and foreigners. Article 3 The people's governments of cities and counties (districts) shall strengthen their leadership over the funeral work, incorporate the funeral work into the national economic and social development plan, and establish and improve the guarantee, coordination and assessment mechanism that is suitable for the development of the funeral cause.

The basic funeral service funds are included in the financial budget management. Article 4 The civil affairs departments of cities and counties (districts) shall be responsible for the funeral management within their respective administrative areas.

The departments of development and reform, ethnic religion, public security, finance, natural resources, ecological environment, housing and urban and rural construction, transportation, water conservancy, agriculture and rural areas, culture, tourism, radio and television, health, emergency, market supervision, forestry, urban management and administrative law enforcement shall, according to their respective responsibilities, do a good job in funeral management.

Town People's government, street offices with the civil affairs departments to do a good job in the area of funeral management.

State organs, social organizations, enterprises and institutions, grass-roots mass autonomous organizations and other social organizations shall cooperate with civil affairs departments to carry out funeral reform, civilized and thrifty funeral and life and culture publicity and education in their own units or organizations. Article 5 The funeral industry organizations shall assist the civil affairs departments to do a good job in funeral management, play the role of coordination and self-discipline in accordance with the articles of association, guide legal activities, fair competition and honest management, improve the service level of the funeral industry, and promote the healthy development of funeral undertakings. Article 6 The people's governments of cities and counties (districts) shall strengthen the registration management of population death information, establish an inter-departmental population death information sharing mechanism, and promote the construction of funeral information management service platform. Chapter II Management of Funeral Facilities Article 7 The municipal civil affairs department shall follow the land and space planning, make plans for the number and layout of funeral facilities according to the funeral needs within its administrative area and in line with the principle of being conducive to funeral reform and convenient for the masses, and implement them after being approved by the Municipal People's Government.

City and county (District) people's governments shall strengthen the construction of land-saving ecological burial facilities, strengthen the ecological functions of burial facilities, and implement land-saving ecological burial methods. Article 8 A funeral parlour shall safeguard state-owned property, provide basic funeral services such as pick-up, temporary storage, cremation, ashes storage and ecological burial of the remains, and strengthen the protection of the remains. Ninth public cemetery should maintain the nature of public welfare and encourage social forces to donate money for construction. It is forbidden to change a public cemetery into a business cemetery without authorization.

In violation of the provisions of the preceding paragraph, if a public cemetery is changed into a business cemetery without authorization, the civil affairs department shall order it to make corrections within a time limit, confiscate its illegal income and impose a fine of three times its illegal income. Tenth public cemetery construction should be in accordance with the principle of benefiting the people and adapting to local conditions, with the county (District) people's government as the main body, and promoted by the town people's government and the street office as a whole to ensure the land and capital investment in public cemetery construction.

City, county (District) civil affairs departments shall, jointly with finance, natural resources, housing and urban and rural construction, agriculture and rural areas, forestry and other relevant departments. To formulate the planning for the construction of public welfare cemeteries within their respective administrative areas, which shall be approved by the people's government at the corresponding level and reported to the civil affairs department at the next higher level for the record. Eleventh public cemetery pricing should be based on the principle of non-profit, taking into account the affordability of urban and rural residents. The price of public welfare cemeteries above the town level shall be uniformly priced by the government, and the specific standards shall be announced to the public after being approved by the county (district) or the municipal development and reform department in conjunction with the civil affairs department according to law; The price of graves in village-level public welfare cemeteries shall be determined by villagers' meetings or villagers' representative meetings according to law and announced to the public. The fees collected are used for the construction, maintenance and management of the cemetery.

Public cemetery business units shall sell graves at the price determined according to law.

Violation of the provisions of the second paragraph shall be punished by the market supervision department in accordance with relevant laws and regulations. Twelfth public cemetery should be in the city, county (District) designated by the civil affairs department to carry out services within the region and scope, and shall not engage in profit-making activities such as marketing graves across regions and beyond.

In violation of the provisions of the preceding paragraph, the civil affairs department shall order it to make corrections and impose a fine of 1 10,000 yuan but not more than 30,000 yuan. Thirteenth cemetery management units to collect cemetery management and maintenance fees for a period of not more than twenty years. Within six months before the expiration of the payment period, the cemetery business unit shall inform the user in writing in a way that can be verified afterwards. If the user needs to keep the tomb, he shall go through the renewal procedures. If it is not handled within three months after the deadline and there is no contract, the cemetery business unit will handle it as a tomb without a owner.

The cemetery management and maintenance expenses extracted by the operating cemetery business unit shall be set up in a separate account, which shall be used exclusively for the daily maintenance and maintenance of graves and ashes storage compartments, and shall not be used for other purposes. Specific measures for the extraction, use and management of cemetery management and maintenance fees shall be formulated by the municipal civil affairs department. Article 14 It is forbidden to transfer, lease or resell graves or spaces.

In violation of the provisions of the preceding paragraph, the civil affairs department shall order it to make corrections within a time limit, confiscate its illegal income, and impose a fine of 30 thousand yuan per grave or place.
