Article 1 In order to guarantee the labor rights of disabled people and realize the goal of "equality, participation and enjoyment" for disabled people. According to the "Regulations on Proportional Employment of Disabled Persons in Hunan Province", combined with the actual situation of our city, these rules are formulated. Article 2 Units and individuals within the administrative area of this Municipality shall abide by these Detailed Rules. These rules are not applicable to welfare enterprises. Article 3 People's governments at all levels shall strengthen the leadership and coordination of the employment of disabled persons, and the departments of civil affairs, labor, personnel and disabled persons' federations shall be responsible for implementing the proportional employment of disabled persons at the corresponding level. City, District, county (city) Disabled Persons' Federation shall set up employment service agencies for the disabled (hereinafter referred to as employment service agencies) to be responsible for the specific affairs of arranging employment for the disabled in proportion. Article 4 The employment targets mentioned in these Detailed Rules are: unemployed disabled persons who have permanent residence in this Municipality, have reached the legal age for employment, have a certain ability to work, have independent employment needs, and meet the standards for disabled persons stipulated by the State Council. Article 5 The total number of employees of state organs, social organizations, institutions, various enterprises and resident units (including more than 3 employees with legal person qualifications, hereinafter referred to as employers) in this Municipality (excluding laid-off workers and temporary workers who are dissatisfied with employment 1 year) is 1? 5% of urban disabled people arrange employment; Township enterprises arrange employment for disabled people in rural areas according to the proportion of 2% of the total number of employees in their own units. Seventh arrangements for the employment of the disabled shall be carried out according to the principle of hierarchical management. Eighth units that have arranged for the disabled can be included in the proportion of arrangements after being confirmed by the employment service agencies. Disabled persons who are disabled due to work shall be arranged for employment by the employer and included in the arrangement proportion. However, the employing unit shall not refuse to arrange for it on the grounds of exceeding the proportion. Disabled relatives of employees in this unit can give priority to employment in this unit. Article 9 Persons with disabilities who meet the employment conditions must register with their employment service agencies, fill in the Registration Form for Unemployed Persons with Disabilities, conduct labor ability appraisal, and participate in pre-job training. Those who pass the examination will be issued with a "Certificate of Unemployment for the Disabled" and will be recommended for employment by virtue of the "Certificate of Unemployment". Tenth disabled employment by the employment service agencies responsible for the recommendation to the employer; Employers can also recruit some disabled people through open recruitment to the public, and go through relevant procedures in the labor and personnel department for the recruited disabled people in accordance with relevant state regulations. Article 11 When arranging employment for the disabled, the employing unit shall arrange appropriate jobs and reasonable labor quotas according to their degree of disability. We must treat our employees equally in the aspects of regularization, grading, promotion, training, professional title evaluation, labor remuneration, welfare treatment, labor insurance and merit evaluation. Article 12 An employing unit shall truthfully submit the annual report of its employees and on-the-job disabled employees to its employment service agencies and labor bureaus before 1 1 every year. Employment service agencies have the right to investigate and verify the reported situation. Thirteenth arrangements for the employment of disabled people can not reach the prescribed proportion of units, according to the difference between the number of people to pay the employment security fund for the disabled to the labor and employment service agencies (hereinafter referred to as the security fund). Article 15 The security fund shall be charged 1 time every year. Sixteenth organs, organizations and institutions to pay security funds from the unit budget; The security funds paid by enterprises and urban and rural collective economic organizations shall be paid from the management expenses. Units that have no financial ability to pay the security fund shall submit a written application and submit the annual financial settlement or budget statement audited by the financial and tax departments at the same level, and report to the disabled persons' Federation at the same level for approval before appropriate relief or holdover. Seventeenth employers who have the conditions to arrange employment for the disabled may not pay security money instead of arranging employment for the disabled. Units that arrange the employment of disabled persons in excess of the proportion shall be given appropriate rewards by their employment service agencies, and the specific reward measures shall be formulated separately. Article 18 Units that fail to pay the security fund within the time limit or fail to pay the security fund in full without approval shall, from the date of delay, impose a daily fine of 0.5% on the overdue part. Units that refuse to arrange employment for the disabled and fail to pay the security fund shall be given administrative sanctions by the competent authorities against the relevant responsible persons and those directly responsible; If the circumstances are serious, it shall be punished in accordance with the relevant provisions of the Measures for the Implementation of the Law of the People's Republic of China on the Protection of Disabled Persons in Hunan Province.
