Regulations of Jiangsu Province on Prevention and Control of Tongyu River Water Pollution

Chapter I General Provisions Article 1 In order to prevent and control the pollution of Tongyu River, ensure the safety of drinking water, and promote the sustainable development of economy and society in coastal areas of this province, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Water Pollution and other laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the prevention and control of pollution of surface water bodies such as Tongyu River, the main water supply channels of Tongyu River and other rivers along the river that affect the water quality of Tongyu River. Article 3 Tongyu River is the main drinking water source for residents along the river, and it also has the functions of irrigation, shipping and flood discharge.

The water quality of Tongyu River and its main water supply channels shall meet the national standards for surface water environmental quality above Class III. Article 4 Tongyu River shall be protected at different levels and divided into three protected areas. Tongyu River and its two sides are one kilometer, and the main water supply channel and its two sides are one kilometer for Tongyu River first-class protection zone; Tongyu River Secondary Protection Zone is located five kilometers upstream and one kilometer on both sides of major rivers intersecting Tongyu River, such as Pianhong, Yanhe, Doulong Port, Xinyang Port, Huangsha Port, Sheyang River, Chelu River, Yinan River and Shuxin River in Xinyi. Five kilometers upstream and one kilometer on both sides of other rivers crossing Tongyu River are the third-class protected areas of Tongyu River. Article 5 The provincial people's government and the local people's governments at or above the county level along the line shall incorporate the prevention and control of Tongyu River water pollution into the national economic and social development plan, intensify the adjustment of industrial structure, promote clean production, develop circular economy, reduce the total discharge of water pollutants, strengthen pollution prevention, supervision and inspection, improve the quality of water environment and ensure the safety of drinking water.

The provincial people's government and the local people's governments at or above the county level along the line should increase investment and arrange funds in the fiscal budget at the corresponding level for the prevention and control of water pollution in Tongyu River. The established environmental protection fund shall set aside a certain proportion for the prevention and control of water pollution in Tongyu River. Article 6 The provincial people's government shall organize local people's governments at or above the county level along the line to establish a linkage consultation mechanism for the prevention and control of water pollution in Tongyu River, and study and solve major problems in the prevention and control of water pollution in Tongyu River.

The prevention and control of water pollution in Tongyu River shall implement the target responsibility system and the assessment and reward and punishment system of local people's governments at all levels. The local people's governments at or above the county level along the line are responsible for the quality of water environment in their respective administrative areas. The main person in charge of the people's governments at all levels along the line is mainly responsible for the term responsibility target of Tongyu River water pollution prevention and control within their respective administrative areas, and the completion of the term goal is an important content of the assessment and evaluation of the main person in charge. Article 7 The competent administrative department of environmental protection of the province and the competent administrative department of environmental protection of the local people's governments at or above the county level along the line shall exercise unified supervision and management over the prevention and control of water pollution in Tongyu River within their respective administrative areas.

The administrative departments of water conservancy, development and reform, economy and informatization, finance, transportation, health, planning, construction, urban management, agriculture, marine and fishery, land and resources of the local people's governments at or above the county level along the line shall, according to their respective functions and duties, do a good job in the supervision and management of pollution prevention and control of Tongyu River. Article 8 The provincial people's government and the local people's governments at or above the county level along the line shall regularly report to the people's congress at the same level or its standing committee on the prevention and control of water pollution in Tongyu River. The Standing Committee of the local people's congress at or above the county level shall regularly supervise and inspect the prevention and control of water pollution in Tongyu River. Article 9 The provincial people's government, the local people's governments at or above the county level along the line and the competent administrative department of environmental protection shall organize publicity and education on water pollution prevention and control laws and regulations and scientific prevention and control knowledge, so as to enhance the consciousness of the whole society to consciously protect the water environment of Tongyu River; Take measures to protect citizens' right to know about the environment, and encourage and support citizens and social organizations to participate in the environmental protection of Tongyu River. Article 10 The provincial people's government, the local people's governments at or above the county level and the relevant administrative departments shall commend and reward the units and individuals that have made remarkable achievements in the prevention and control of water pollution in Tongyu River. Chapter II Supervision and Management Article 11 The provincial environmental protection administrative department shall, jointly with the relevant provincial water conservancy administrative departments and the relevant people's governments along the line, prepare a plan for the prevention and control of water pollution in Tongyu River and submit it to the provincial people's government for approval.

Special plans or schemes for urban domestic sewage treatment, drinking water source safety, agricultural non-point source pollution prevention and control, and ship pollution prevention and control along the Tongyu River shall be formulated and implemented by the relevant administrative departments of housing and urban and rural construction, water conservancy, agriculture, transportation and other provinces in conjunction with the relevant departments of the people's government at the same level and the relevant people's governments along the line according to the relevant plans for pollution prevention and control of Tongyu River. Article 12 The relevant administrative departments of the provincial people's government shall regularly inspect and evaluate the implementation of special plans or schemes such as Tongyu River water pollution prevention and control planning and urban domestic sewage treatment along Tongyu River, report the evaluation results to the provincial people's government, and notify the local people's governments at or above the county level along the line. Article 13 According to the need of water quality protection of Tongyu River, the provincial administrative department of development and reform, economy and informatization shall, jointly with the provincial administrative department of environmental protection, formulate a catalogue of industries and products that are prohibited, restricted and eliminated, and submit it to the provincial people's government for approval before promulgation and implementation. Article 14 The provincial people's government shall, according to the needs of protecting the water quality of Tongyu River, optimizing the industrial structure and adjusting the industrial layout, formulate local water pollutant discharge standards that are stricter than the national standards in a timely manner, and announce them to the public.
