Interim Provisions of Guiyang Municipality on the Administration of Landscaping Construction Team

Article 1 In order to strengthen the management of the landscaping construction team in our city, establish the normal order of the landscaping construction market, and promote the healthy development of landscaping, these Provisions are formulated in accordance with the relevant provisions of the national urban construction management and combined with the situation in our city. Article 2 The term "landscaping construction team" as mentioned in these Provisions refers to the construction team specialized in or engaged in landscaping. All construction teams engaged in landscaping projects within the administrative area of this Municipality shall abide by these provisions.

Landscaping project refers to planting trees, flowers and ground cover plants in scenic spots, urban public areas or special green spaces and courtyards, laying lawns and building gardens, pavilions, bridges, ponds, rockeries, stone tables, benches and other landscaping facilities. Article 3 The Guiyang Municipal Bureau of Landscaping and Greening (hereinafter referred to as the Municipal Bureau of Landscaping and Greening) is the competent department in charge of the landscaping construction team in our city, and its main tasks are:

(a) to implement the national guidelines, policies and regulations on the management of landscaping construction teams;

(two) to formulate the provisions of the city's landscaping construction team management;

(three) to inspect and supervise the landscaping construction activities and the quality of landscaping construction, and to examine and approve the landscaping construction budget in conjunction with the Construction Bank;

(four) responsible for the qualification examination and registration of all landscaping construction teams, and issue qualification examination certificates;

(five) the preparation and revision of Guiyang city landscaping project quota, seedling reference price list. Article 4 The competent department of the landscaping construction team shall strengthen the management of the construction team together with the construction unit, and the departments of industry and commerce, taxation, China Construction Bank, auditing, justice, price and transportation shall give support and cooperation. Fifth teams engaged in landscaping construction must meet the following basic conditions:

(1) Having a sound organizational structure and being able to organize production and operation independently;

(2) Having full-time technical personnel, management personnel and production technical workers suitable for undertaking construction tasks;

(3) Having production machines and tools suitable for undertaking construction tasks and its own funds;

(4) Having a sound financial system, accounting methods and management regulations;

(5) Having a fixed office space. Sixth teams engaged in landscaping construction, according to their technical qualifications, scale and economic strength, are divided into one, two and three levels, and must meet the following conditions:

The first-level team should have 2 landscaping engineers, 1 civil engineer 1 name, accountant or accountant who has been engaged in accounting work 15 years or more, more than 50 regular employees, and its own funds are not less than 200,000 yuan.

The second-level team should have landscaping engineers, assistant civil engineers, assistant accountants or accountants who have been engaged in accounting for more than 10 years, with more than 30 regular employees and self-owned funds of not less than 654.38+10,000 yuan.

The third-level team should have landscaping assistant engineers, civil engineers, accountants or accountants who have been engaged in accounting for more than 5 years, with more than 0/5 regular employees and self-owned funds of not less than 20,000 yuan. Seventh levels of landscaping construction team business scope:

(1) A team can undertake landscaping projects of any scale;

(2) The second-level team can undertake the landscaping project with a total cost of10.5 million yuan (including10.5 million yuan);

(three) three teams, can undertake the general landscaping project with a total cost of less than 50 thousand yuan (including 50 thousand yuan). Article 8 The establishment of the landscaping construction team shall be subject to the consent of the administrative department at a higher level, and the application registration form for the landscaping construction team shall be obtained from the Municipal Bureau of Gardens with the approval documents and the opening report, which shall be truthfully filled in and sent to the Municipal Bureau of Gardens for review. Those who pass the qualification examination shall be issued with a certificate of qualification examination, registered with the administrative department for industry and commerce, obtained a business license and registered with the tax authorities.

Before the promulgation of these Provisions, the established landscaping construction team shall reissue the qualification examination certificate, renew the license and go through the tax registration in accordance with the provisions of the preceding paragraph.

The landscaping construction team that fails to establish and replace the license according to the regulations shall not engage in the landscaping construction business. Offenders should be held accountable. Ninth field to enter the city's landscaping construction team, must meet the following conditions:

(a) the certificate of going abroad issued by the competent department of landscaping construction industry and the administrative department for industry and commerce at or above the county level;

(2) Business license (copy);

(3) A certificate of self-owned funds issued by the local bank;

(4) A tax administration certificate issued by the local taxation bureau at or above the county level;

(five) certificates of technical personnel and construction legal person, employee work permit and roster. Tenth foreign construction team leaders must hold the documents listed in Article 9 of these Provisions to the Municipal Bureau of Gardens for registration and examination, and those who pass the examination will be issued with qualification examination certificates. Then go to the administrative department for industry and commerce and the tax department for business license and tax registration. And according to 20% of the total investment of the project undertaken, the deposit for the project under construction shall be paid to the Municipal Construction Bank, and the deposit unit shall not misappropriate it. After the project is completed and accepted, the Municipal Bureau of Landscape Architecture will issue a certificate, and then the Municipal Construction Bank will return the principal and interest. Eleventh teams engaged in landscaping construction within the administrative area of this Municipality must open an account with the Municipal Construction Bank and accept the supervision and management of the Construction Bank. Twelfth landscaping construction team and the construction unit signed a construction contract and final accounts, must go through the supervision procedures at the Municipal Bureau of Gardens. If the procedures are incomplete, the Municipal Construction Bank will not pay the project funds.
