What procedures and materials are needed for marriage registration?

Application, examination and registration are three links in the process of marriage registration.

(1) application

Those who meet the conditions of marriage registration, with relevant documents, certificates and 3 registration photos, apply for marriage registration at the marriage registration office where one party's household registration is located, and fill in the declaration required for applying for marriage registration on the spot.

The documents and materials for applying for marriage registration depend on individual circumstances. For example, when mainland residents apply for marriage registration, they need to hold their ID card, household registration book, proof of premarital examination, a signed statement that they have no spouse and no direct blood relationship with each other and collateral blood relationship within three generations. For divorced parties, they also need to hold divorce certificates or divorce proof materials.

Foreigners (including foreigners residing in China or temporarily staying, foreigners from China and foreigners residing in China) applying for marriage in Chinese mainland must hold their own identity documents (passports or other nationality documents), foreigners' residence permit or temporary entry and residence certificate, and proof of marital status issued by embassies and consulates in China in that country.

(3) Registration (Licensing)

The marriage registration authority shall register those who meet the conditions for marriage and issue a marriage certificate to the parties concerned; For divorced people who want to remarry, the marriage registration office will cancel their divorce certificates; For those who do not meet the conditions for marriage registration, the marriage registration authority will issue a notice of disapproval of marriage registration according to the requirements of the parties, explaining the reasons for disapproval.

What procedures and documents do you need for divorce?

The divorce registration procedure is as follows:

(1) application

If the husband and wife voluntarily divorce in the Mainland, they shall conclude a written divorce agreement and jointly apply to the marriage registration authority with jurisdiction, and provide the following application materials as required:

Within 30 days from the date when the marriage registration office receives the application for divorce registration and sends the receipt of the application for divorce registration to the parties concerned, if either party disagrees with the divorce, it can withdraw the application for divorce registration from the marriage registration office that accepted the application for divorce registration with its valid ID card, receipt of the application for divorce registration and other related materials (if the receipt cannot be found, the reasons can be explained in writing), and fill out the Application for Withdrawal of Divorce Registration in person. After verification, the marriage registration authority shall issue the Confirmation Letter for Withdrawing the Application for Divorce Registration. Within 30 days after the expiration of the cooling-off period for divorce, if both parties fail to apply to the marriage registration authority for issuing a divorce certificate, the application for divorce registration shall be deemed to have been withdrawn.

(4) Review

Within 30 days after the expiration of the cooling-off period of divorce (if the last day of the period is a holiday, the first day after the holiday is the expiration date), divorced couples should carry valid documents and materials according to relevant regulations, such as divorce agreement, marriage certificate, photos and valid documents to prove their identity. , and apply to the marriage registration authority for a divorce certificate. The marriage registration authority shall conduct the examination in accordance with the relevant procedures and conditions. If the divorce registration conditions are not met, the divorce registration shall not be granted. The marriage registration authority shall issue a notice of divorce registration if the party concerned requests it.
