Interim Provisions of Kunming Municipality on the Administration of Security Organizations and Security Guards
Security guard refers to the personnel who are stationed in the client unit by the security service company or directly employed by the employer to engage in security services. Article 3 Security services must implement the policy of "prevention first, ensuring safety" and aim at "serving the society, serving the people, safeguarding the legitimate rights and interests of units and people, and improving the overall security and prevention ability of society". Article 4 The competent departments of conservative service companies and security organizations are public security organs, and their business activities are under the guidance and supervision of the public security organs. Without the approval of the public security organs, no unit or individual may set up security service companies, security organizations, and employ and use security guards without authorization. Chapter II Organizational Structure Article 5 The establishment of security service companies by all relevant units within the administrative area of this Municipality must be examined by the Municipal Public Security Bureau and approved by the Provincial Public Security Department, and they can only operate after applying for registration with the administrative department for industry and commerce with the license issued by the public security organ and obtaining the business license. Article 6 Units that need to establish security organizations or employ security guards must sign contracts with security service companies, which will send security guards or provide security consultation and business guidance. The establishment of a security organization requires an application to the local police station, which shall be audited by the county (district) Public Security Bureau and reported to the Municipal Public Security Bureau for approval. Article 7 A security service company may set up security squadrons, teams (departments), groups and other institutions according to the number of security guards or consulting units stationed. Article 8 The person in charge of the security organization shall be recommended by the person in charge of the security service company or the unit that established the security organization, and shall be a politically reliable person with a strong sense of responsibility and certain security work experience, and shall be reported to the county (district) public security organ for approval. Chapter III Duties and Discipline Article 9 Duties of a security service company:
(1) Abide by national laws and regulations and conduct business activities according to law;
(two) strictly fulfill the contract, and effectively protect the legitimate rights and interests of customers;
(three) to stop violations of law and discipline and maintain the internal order of the entrusting unit;
(four) to establish rules and regulations, strengthen the management of security team, improve the quality of security guards and security service quality. Article 10 Responsibilities of security personnel:
(1) Maintaining public order of service units according to law, preventing and stopping illegal and criminal activities, and protecting the legitimate rights and interests of customers or employers from infringement;
(two) to protect the scene of criminal and public security cases in the area of responsibility and maintain the order at the scene;
(3) Offenders in flagrante delicto shall be handed over to public security organs for handling;
(four) check the personnel, vehicles and suspicious items entering and leaving the area of responsibility;
(five) check the implementation of fire prevention, theft prevention, explosion prevention, prevention and control of safety disasters and accidents, and timely rectify or report unsafe hidden dangers;
(six) actively fight against illegal and criminal acts and report to the public security organs in a timely manner. Eleventh according to the relevant laws and regulations of the state, security guards shall not exercise the following functions and powers:
(a) The power to detain, imprison, search or confiscate property and impose fines;
(two) to investigate and deal with criminal cases or public security cases;
(three) to participate in the investigation and handling of economic and labor disputes between enterprises and associations or debt collection and money collection. Article 12 the discipline of security personnel
(a) strictly abide by the laws and regulations of the state and the relevant rules and regulations formulated by the competent department;
(2) Obeying orders and commands;
(three) abide by the contract, pay attention to discipline, civilized duty, and maintain the image of the public security team;
(four) stick to their posts, be vigilant and do their duty to ensure the safety of guards and nursing objects;
(five) act in strict accordance with the law, it is forbidden to be rude, insult the masses, insult others, and not to act as a personal bodyguard;
(6) It is forbidden to drink and smoke in the no-smoking area before taking up the post or while on duty;
(seven) non working hours, do not wear security clothes and carry security equipment to go out;
(eight) close contact with the masses, and consciously accept the supervision of the masses;
(nine) strictly observe the confidentiality of work and abide by the discipline of foreign affairs. Chapter IV Recruitment and Assessment Article 13 The security service company is responsible for the training and assessment of security guards recruited by the company and security guards of consulting units.
Security guards are mainly recruited from demobilized soldiers, and a small number are openly recruited from the society. Article 14 A security guard shall meet the following conditions:
(a) politically reliable, decent style, strong sense of responsibility;
(two) strong legal concept, love security services;
(3) Dare to fight against criminals;
(4) Having no criminal record;
(5) Being in good health and having a junior high school education or above;
(6) Age 18 to 35 years old. If the internal staff of the unit serves as the security guard of the unit, the lower age limit may be appropriately relaxed, but the maximum age shall not exceed 50. Fifteenth recruitment of security guards, candidates must have the following documents and certification materials:
(1) My identity card;
(two) the recruitment of security guards in this city, issued by the local police station;
(3) Foreign candidates must report to the county or district public security organs for approval before they can be hired, except for their identity documents and political examination materials from the local police station where their registered permanent residence is located.
