Measures for the implementation of Hainan's second-class construction engineer registration?

It is very important to implement the "Measures for the Registration of Secondary Construction Engineers in Hainan". Although it is different from other provinces and cities, it is similar in general and has reference value. Zhong Da Consulting will introduce the implementation measures for the registration of Hainan second-class construction engineers.

I. Registration Management System

Article 1 In order to standardize the registration management of second-level construction engineers, these implementation measures are formulated in accordance with the Administrative Licensing Law and the Regulations of the Ministry of Construction on the Administration of Registered Construction Engineers (Ministry of Construction Decree No.2004). 153), the implementation measures for the registration of first-class builders (Jianshi [2007] 10 1) and relevant laws and regulations.

Article 2 The Construction Department of Hainan Province is responsible for the registration and examination and approval of the second-level construction engineer. The provincial department in charge of transportation and information industry is responsible for the registration and examination of the second-level construction engineer of highway, communication, radio and television majors in the province.

Second, the registration procedure

Article 3 Before applying for registration, the applicant shall be employed by an enterprise with the qualifications of construction or survey, design, supervision, bidding agency and cost consultation, and sign an employment contract with the employing enterprise according to law. The applicant shall truthfully provide relevant application materials to the employing enterprise and be responsible for the authenticity of the content, and apply for registration to the Provincial Construction Department through the employing enterprise.

Article 4 An application for registration shall be made in writing. Applicants need to download and fill in the application form on Hainan Construction Information Online (website: //www.hncic.net).

Article 5 Application for registration includes initial registration, renewal registration, change registration, additional registration, cancellation registration and re-registration. If a registered architect loses or defaces his registration certificate or practicing seal, he may apply for a replacement or renewal.

Article 6 Initial registration

Within 3 years from the date of issuance of the qualification certificate, the applicant may apply for initial registration. If it fails to do so within the time limit, the applicant shall provide the corresponding professional continuing education certificate, and its learning content shall comply with the provisions of the Ministry of Construction on the continuing education of registered architects.

To apply for initial registration, the applicant shall submit the following materials:

(1) application form for initial registration of second-level constructor (attached table1-1);

(two) a copy of the qualification certificate, academic certificate and identity certificate;

(three) a copy of the employment contract signed by the applicant and the employing enterprise or a certificate of labor, personnel and salary relationship issued by the applicant's enterprise;

(four) overdue application for initial registration, it shall provide a copy of the certification materials that meet the requirements of continuing education.

The application materials consist of the application form and the material attachments bound by parts (2), (3) and (4).

The employing enterprise shall submit the Summary of the Application for Initial Registration of Enterprise's Secondary Construction Engineer (attached table 1-2) and the applicant's application form and material attachments to the Provincial Construction Department. Among them, to apply for professional registration of construction, municipal administration, railway, water conservancy and hydropower, mining, electromechanical and civil aviation, an application form in duplicate and material attachments shall be submitted; To apply for professional registration of highways, ports and waterways, communications, radio and television, an application form shall be submitted in triplicate and two attachments to the materials; To apply for additional registration of highway, port and waterway, communication, radio and television majors, an application form and material attachments shall be added for each additional major.

Involving highway, port and waterway, communications and radio and television professional application for registration, the provincial construction department will send the applicant's application form and material attachments to the relevant professional departments in the province.

The relevant professional departments of the province shall review the applicant's application materials, and fill in the "Review Opinion Form for Initial Registration of Secondary Construction Engineers of the Relevant Departments of the province" (attached table 1-4) and forward it to the Provincial Construction Department.

Article 7 Renewal of registration

If it is necessary to continue practicing after the expiration of the registration period, it shall apply for renewal of registration in accordance with the provisions of Articles 7 and 8 of the Regulations on the Administration of Registered Architects 30 days before the expiration of the registration period. The renewal of registration is valid for 3 years.

To apply for renewal of registration, the applicant shall submit the following materials:

(1) application form for the renewal of registration of the second-level constructor (attached table 2-1);

(2) the original registration certificate;

(three) the employment contract signed by the applicant and the employing enterprise or the certificate of labor, personnel and salary relationship issued by the applicant's employing enterprise;

(four) a copy of the certification materials that meet the requirements of continuing education within the validity period of the applicant's registration.

The application procedure and the number of copies of materials shall be handled according to the initial registration requirements.

Article 8 Change of registration

Within the validity period of registration, in any of the following circumstances, it shall apply for change of registration in time. After the change of registration, the validity period of the original registration certificate shall be implemented.

1. The practicing enterprise changes;

2. The name of the employed enterprise changes;

3. The name of the registered architect has changed.

To apply for registration of change, the applicant shall submit the following materials:

(1) Application Form for Change of Registration of Class II Construction Engineer (Attached Table 3-1);

(2) The original registration certificate and practicing seal;

(3) If the practicing enterprise changes, provide the employment contract signed by the applicant and the newly hired enterprise, or the labor, personnel and salary relationship certificate issued by the applicant's employing enterprise, and a copy of the job transfer certificate (the termination or expiration certificate of the employment contract with the original employing enterprise, and the retirement certificate of retirees);

(4) If the name of the enterprise where the applicant works changes, a copy of the changed business license of the enterprise as a legal person and a copy of the letter of change of enterprise name issued by the administrative department for industry and commerce where the enterprise is located shall be provided.

(5) If the name of a registered architect changes, the original identity certificate after the change or a valid certificate issued by the household registration administration department of the public security organ shall be provided.

Article 9 Registration of Supplementary Items

A registered architect who has obtained the corresponding professional qualification certificate may apply for additional registration. If the newly-added vocational qualification certificate has not been registered for more than 3 years, it shall provide the certificate of continuing education and study of the major during the latest registration period. After the additional registration is granted, the validity period of the original professional registration remains unchanged.

To apply for additional registration, the applicant shall submit the following materials:

(1) Application Form for Additional Registration of Class II Constructor (Attached Table 4-1);

(two) a copy of the qualification certificate of the additional vocational qualification examination;

(3) The original registration certificate and practicing seal;

(four) a copy of the certification materials that the added major meets the requirements of continuing education.

The application procedure and the number of copies of materials shall be handled according to the initial registration requirements.

Article 10 Cancellation of registration

Registered construction engineer has one of the circumstances listed in Article 16 of the Regulations on the Administration of Registered Construction Engineers, and the cancellation formalities shall be handled by the Provincial Construction Department.

The applicant or the enterprise it employs shall provide the following materials:

(1) Application Form for Cancellation of Registration of Class II Construction Engineer (Attached Table 5-1);

(2) The original registration certificate and practicing seal;

(three) a copy of the certificate that meets one of the circumstances listed in Article 16 of the Regulations on the Administration of Registered Construction Engineers.

The registered construction engineer himself and the employing enterprise shall submit an application for cancellation of registration to the Provincial Construction Department in a timely manner; The relevant units and individuals have the right to report to the registration authority; City, county, autonomous county construction departments or relevant departments shall promptly inform the registration authority.

Article 11 Re-registration

If the constructor cancels the registration or refuses to register, he may apply for re-registration after meeting the registration conditions again, and the re-registration shall be handled in accordance with the initial registration requirements.

To apply for re-registration, the applicant shall submit the following materials:

(1) Application Form for Re-registration of Class II Constructor (Attached Table 6-1);

(two) a copy of the qualification certificate, academic certificate and identity certificate;

(three) a copy of the employment contract signed by the applicant and the employing enterprise or a certificate of labor, personnel and salary relationship issued by the employing enterprise;

(four) a copy of the certification materials that meet the requirements of continuing education.

The application procedure and the number of copies of materials shall be handled according to the initial registration requirements.

Twelfth registration certificate, practice seal lost replacement.

If a registered construction engineer loses his registration certificate and practicing seal, he shall apply to the Provincial Construction Department for a replacement, and submit the following materials:

(1) Application Form for Reissuing the Registration Certificate and Practice Seal of Class II Architect (Attached Table 7-1);

(2) A copy of the identity certificate;

(three) the original loss statement published in the provincial newspaper.

Thirteenth registration certificate, practice seal defaced replacement.

If the registration certificate and practicing seal are defaced, you may apply to the Provincial Construction Department for replacement, and submit the following materials:

(a) the "second-class construction engineer registration certificate, practice seal lost replacement or defaced application form";

(2) A copy of the identity certificate;

(three) the original registration certificate and practicing seal.

Article 14 A person who has obtained the qualification certificate of Grade II constructor may apply for registration in the following majors: construction engineering, highway engineering, railway engineering, civil aviation engineering, port and waterway engineering, water conservancy and hydropower engineering, municipal public works, communication and radio and television engineering, mining engineering and electromechanical engineering.

If the major indicated in the qualification certificate is housing construction engineering or decoration engineering, it shall apply for registration according to the major of construction engineering; If the major indicated in the qualification certificate is mining engineering, apply for registration according to the major of mining engineering; If the major indicated in the qualification certificate is smelting engineering, you can choose a major in mining engineering or electromechanical engineering to register; If the major indicated in the qualification certificate is power engineering, petrochemical engineering and mechanical and electrical installation engineering, the applicant shall apply for registration as a mechanical and electrical engineering major.

Three. Acceptance and approval

Fifteenth Provincial Construction Department accepts and approves the application for registration of second-level construction engineers with reference to the Provisions on the Implementation of Administrative Licensing by the Construction Department of Hainan Province. The acceptance and approval of the application for registration shall not be handled by the same person, so as to ensure legal procedures and standardized behavior.

Article 16 The Provincial Department of Construction shall check the material integrity of the registered applicant in accordance with the relevant provisions of initial registration, renewal registration, change registration, additional registration, re-registration, loss reporting and replacement, defaced replacement and cancellation of registration. If there are errors in the application materials that can be corrected on the spot, the applicant shall be allowed to correct them on the spot.

If the registration application materials are complete and conform to the statutory form, or the applicant submits all the corrected application materials as required, it shall accept the applicant's registration application and issue the Notice of Acceptance of Administrative License to the applicant.

If the application materials are not in conformity with these provisions or the materials are incomplete, it shall issue a Notice on the Relevant Materials of Administrative License Correction to the applicant on the spot or within 5 days, inform the applicant of all the contents that need to be corrected at one time, and return the application materials to the applicant. Failure to inform within the time limit shall be accepted as of the date of receipt of the registration application materials.

In any of the following circumstances, the applicant shall not accept or register:

(a) does not have full capacity for civil conduct;

(2) applying for registration in two or more enterprises;

(3) Being subjected to criminal punishment, which has not been completely executed;

(4) Being subjected to criminal punishment for practicing activities, and less than 5 years have elapsed since the date of completion of the execution of the punishment and the date of application for registration;

(5) Having been subjected to criminal punishment for reasons other than those mentioned in the preceding paragraph, and it has not been more than three years since the date of punishment decision to the date of application for registration;

(six) the registration certificate has been revoked, and it has been less than 2 years since the date of punishment decision to the date of application for registration;

(seven) within three years before the date of applying for registration as the person in charge of the project of the construction enterprise, there have been major quality and safety accidents in the project in charge;

(eight) the applicant's employment enterprise does not meet the requirements of the registered enterprise;

(nine) over 65 years old;

(10) Other circumstances in which registration is not allowed by laws and regulations.

Seventeenth provincial construction department to review the applicant's application materials, carefully check whether the qualification certificate, academic certificate, identity certificate, continuing education certificate and the original and photocopy of the employment contract are consistent.

Eighteenth Provincial Construction Department shall, within 20 days from the date of accepting the application, review the applicant's registration conditions and application materials, and make a written decision on the initial registration, re-registration and additional registration applications, and the examination and approval results shall be announced to the public. Provincial transportation, information industry and other professional departments shall complete the audit within 10 days from the date of receiving all the application materials for registration, and summarize the audit opinions in writing and then forward them to the provincial construction department. The Provincial Construction Department will publicize the audit opinion results to the public 10 days. If there is no objection to the publicity, registration shall be granted.

Article 19 Where an application for change of registration, cancellation of registration, loss of registration certificate or practice seal is reissued or defaced, the Provincial Construction Department shall be responsible for handling it and settle it within 5 days.

If the names of practicing enterprises, enterprises and registered construction engineers change and pass the examination by the Provincial Construction Department, they shall be registered in the column of change of registration certificate. In case of inter-provincial change, the registered construction engineer shall apply for change, and after the original employing enterprise reports to the original provincial construction office for approval, it shall be audited and handled by the transferred provincial construction office.

Cancel the registration and destroy the recovered registration certificate and practicing seal. The Provincial Construction Department will announce the cancellation of registration certificate and practicing seal on Hainan Construction Information Online within 10 days.

If the registration certificate and practicing seal are lost, reissued or defiled and need to be replaced, the recovered registration certificate and practicing seal shall be destroyed and replaced, and the Provincial Construction Department shall announce the replacement or reissued registration certificate and practicing seal on Hainan Construction Information Online within 10 days.

Article 20 Where an applicant applies for renewal of registration, it shall, within 10 days from the date of acceptance, examine and approve the applicant's renewal registration conditions and application materials, make a written decision, and announce the approval result to the public. Provincial transportation, information industry and other professional departments shall complete the audit within 5 days from the date of receiving all the application materials for registration, and make a written summary of the audit opinions and then transfer them to the provincial construction department. The Provincial Construction Department will summarize the audit results and publicize them to the public 10 days. If there is no objection, registration will be granted. The date of examination and approval is the date of issuance of the registration certificate, which is valid for 3 years from the date of issuance, and the practicing seal is the same as the registration certificate.

Twenty-first provincial construction department shall, from the date of announcement 10, issue the registration certificate and practicing seal of China people's * * * and national second-class construction engineer to the applicant who is granted registration. The Provincial Construction Department is responsible for stamping the photo of the registration certificate with the steel seal of riding seam and the official seal of the registration certificate. After examination and approval, it is agreed to renew registration, add registration and cancel registration. The Provincial Construction Department will affix the anti-counterfeiting logo uniformly printed by the Ministry of Construction on the inner page of the registration certificate, and affix the riding seal.

Report to the Ministry of Construction for the record within 30 days after the issuance of the "People's Republic of China (PRC) Class II Construction Engineer Registration Certificate" and the practicing seal.

Four. Registration certificate and practicing seal

Article 22 Registration certificate

The registration certificate is made of dark green paper, rectangular, with a length of 124mm and a width of 87mm, which is uniformly printed by the Ministry of Construction.

(a) the registration certificate adopts two numbering systems. The registration number consists of a Chinese character and 12 Arabic numerals, and the certificate number is the serial number printed by the registration certificate of the whole province;

(two) the registration number rules apply to the registration number of the second-level constructor. The Chinese characters of the registration number and the meanings of each group of numbers are:

The first Chinese character in the number 1. indicates the abbreviation of Hainan Province, namely "Qiong".

2. The second representative is registered as a builder, that is, the second level is 2;

3. The third and fourth digits indicate the administrative division code of the place where the enterprise is located at the time of initial registration, such as "0 1" for Haikou and "06" for Qionghai.

4. The fifth and sixth digits indicate the year when the qualification certificate was obtained. Qualification certificate obtained in 2006, marked as "06";

5. The 7th and 8th digits indicate the year of initial registration, and if it is initial registration in 2007, it is "07";

6. The serial number 9- 13 indicates the serial number of the applicant's initial registration. For example, the number 1 means "000 1".

For example, Joan 20 106070000 1 indicates that the registered architect is currently registered in Hainan with Grade II, registered for the first time in Haikou, obtained the qualification certificate in 2006, registered for the first time in 2007, and registered for the first time with the serial number of 0001. (3) The first Chinese character in the registration number represents the registration at that time. If it is renewed, changed or re-registered, the first Chinese character of the number will change with the change of the registered province, and the digital number is still the number at the time of initial registration.

(4) The registration number of the registration certificate is the same as the practicing seal.

Article 23 practicing seal

(1) Practice Seal Specification

1. The seal is concentric double ellipse. The specifications are: the major axis of the outer circle is 50mm, the minor axis is 36mm, the major axis of the inner circle is 36mm, and the minor axis is 22 mm The stamp color is dark blue.

2. The practicing seal shall be made according to the specifications and format of the sample seal, and marked in turn:

(1) "Professional Seal of People's Republic of China (PRC) * * * and People's Republic of China (PRC) Secondary Construction Engineer", in Song typeface, with a word height of 4 mm;

(2) The name of the seal holder, in Chinese official script, with a word height of 4 mm;

(3) Registration number and seal check code, in song typeface, 3.5mm in word height;

(4) Registered major, Song Ti, with a word height of 3 mm;

(5) The expiration date of the practicing seal is 2.5mm in terms of song style and word height;

(6) The name of the employing enterprise is ì 4 mm 4 mm. 3. In "Qiong 20 106070000 1(02)", "Qiong 20 106070000 1" is the registration number, and 02 is the signature check code.

4. "20 10.09.07" in the sample stamp indicates that the effective deadline of the seal is 20 19.7.

(2) Practice seal verification code

The signature check code consists of two Arabic numerals, indicating the cumulative number of reissues after the signature is lost and invalidated. At the time of initial registration, the check code is 00, 1 time is 0 1, and the maximum number of times is 99.

(three) registered professional abbreviation

Construction engineering, highway engineering, railway engineering, civil aviation, port and waterway engineering, water conservancy, municipal public works, communication, mining engineering, electromechanical engineering. The abbreviations of various majors are connected by a space ",",indicating that there are multiple registered majors. For example, "Building Highway" is the specialty of building engineering and highway engineering.

(4) No matter whether the applicant registers one major or multiple majors, only one registration certificate and one practicing seal can be issued.

(5) If more than one major has been registered, and the expiry date of the registration period is different among the majors due to additional registration, renewal of registration or cancellation of registration, the expiry date of the practicing seal shall be the earliest expiry date of the registration period.

Verb (short for verb) others

Article 24 After the second-level construction engineer is registered, when receiving the registration certificate and practicing seal, he should also return the qualification certificate of the second-level project manager of the original construction enterprise to the provincial construction department, which will be responsible for destroying the certificate and reporting it to the Ministry of Construction for the record.

Twenty-fifth Provincial Department of Construction does not charge registration fees for two-level construction engineers. The relevant expenses incurred in the registration work shall be solved by the relevant competent departments at the same level. The registration certificate fee and seal production fee standards shall be submitted to the provincial price management department for approval.

Article 26 The registration management of first-class construction engineers shall be implemented in accordance with the Implementation Measures for the Registration of First-class Construction Engineers (J.J. [2007]1KLOC-0/No.) issued by the Ministry of Construction.

Twenty-seventh the implementation measures shall be interpreted by the Construction Department of Hainan Province.

Article 28 These Measures shall be implemented as of the date of promulgation.
