Provisions of Nanning Municipality on the Development of Bulk Cement and Ready-mixed Concrete (revised in 2005)

Article 1 In order to speed up the development of bulk cement and ready-mixed concrete, save resources, protect the environment, ensure the quality of construction projects, and improve the comprehensive economic and social benefits, these Provisions are formulated in accordance with the relevant provisions of the state and the autonomous region and combined with the actual situation of this Municipality. Article 2 These Provisions shall apply to units and individuals engaged in the production, operation, transportation and use of cement and ready-mixed concrete within the administrative area of this Municipality. Article 3 The Municipal Economic Commission and the Municipal Construction Bureau are respectively the administrative departments in charge of bulk cement management and ready-mixed concrete management in this Municipality.

City bulk cement management agencies, city ready mixed concrete management agencies are responsible for the specific work of the city's bulk cement management and ready mixed concrete management, their duties are:

(a) to implement the principles, policies, regulations and rules of the state, autonomous regions and this Municipality for the development of bulk cement and ready-mixed concrete.

(two) to organize the preparation and implementation of the development plan and annual plan of bulk cement and ready mixed concrete in this area.

(three) to supervise and manage the production, operation, transportation and use of bulk cement and ready-mixed concrete.

(four) bulk cement management institutions in accordance with the relevant provisions of the state and the autonomous region, the collection, management and use of bulk cement special funds.

(five) responsible for the development of bulk cement and ready-mixed concrete information exchange, publicity and education, business training, statistics and the popularization and application of new technologies, new processes and new equipment.

(six) coordinate and solve the problems existing in the development of bulk cement and ready-mixed concrete management. Article 4 Bulk cement and ready-mixed concrete must be used in construction projects in urban areas and other areas determined by the Municipal People's Government.

The Municipal People's Government shall, according to the needs of urban development, adjust the scope of use of bulk cement and ready-mixed concrete, and publish it regularly. Fifth the following construction projects must use ready-mixed concrete:

(a) key construction projects, water conservancy and flood control projects, municipal projects, transportation infrastructure construction projects, residential areas developed in pieces;

(two) the construction site is located in densely populated residential areas and school construction projects;

(three) other construction projects with a one-time cast concrete volume of more than 6 cubic meters. Article 6 In addition to ready-mixed concrete, bulk cement must be used in the following construction projects:

(a) the proportion of bulk cement used in key construction projects, municipal projects and residential areas developed in pieces must reach more than 90%.

(2) For other construction projects with a building area of 1500 square meters or a cement consumption of more than 300 tons, the proportion of using bulk cement must reach more than 80%.

Cement products production enterprises and ready-mixed concrete mixing stations must all use bulk cement. Article 7 For construction projects that must use ready-mixed concrete in accordance with Article 5 of these Provisions, the requirements for using ready-mixed concrete shall be included in the construction bidding documents and construction contracts. Eighth city bulk cement management institutions in accordance with the relevant provisions of the state and the autonomous region, in accordance with the following items, scope and standards to collect special funds for bulk cement (hereinafter referred to as special funds):

(1) Cement production enterprises shall collect special funds 1 yuan for each ton of bagged cement (including paper bags, plastic woven bags and composite bags) sold (including exported).

(two) the construction unit or other cement users each purchase and use of a ton of bagged cement to collect special funds 3 yuan.

Except as otherwise provided by the state and the autonomous region, no unit or individual may arbitrarily change the object of collection, expand the scope of collection, raise the collection standard or reduce or exempt special funds. Ninth cement production enterprises should pay special funds by the municipal bulk cement management agencies responsible for the collection; The special funds that should be paid by the construction unit or other cement users shall be collected by the municipal bulk cement management institution or entrusted by the relevant administrative departments. Tenth cement production enterprises should pay special funds according to the approved monthly sales of bagged cement, and turn them over to the municipal bulk cement management institution before the next month 10. The special funds paid by cement production enterprises shall be charged in the management expenses.

The special funds that should be paid by the construction unit shall be paid in advance to the municipal bulk cement management institution according to the cement consumption in the project budget when the construction unit goes through the construction application procedures. If the proportion of bulk cement or ready-mixed concrete used in construction projects is lower than that stipulated in Articles 5 and 6 of these Provisions, the special funds paid in advance will not be refunded. The special funds paid by the construction unit are included in the construction cost of Jian 'an Project.

The special funds payable by the producers of cement products shall be approved according to the cement consumption in the previous year and turned over to the municipal bulk cement management institution before the first month of each quarter 15. The special funds paid by the producers of cement products shall be charged in the management expenses. Article 11 When a construction unit applies for a project bidding construction permit, the construction administrative department or other administrative departments shall, in accordance with the provisions of Articles 5, 7 and 8 of these Provisions, review the use of ready-mixed concrete and the payment of special funds for the project. If it is found that the ready-mixed concrete is not explicitly used in the tender documents and construction contracts or the special funds are not paid, the construction unit shall be required to explicitly use the ready-mixed concrete or pay the special funds in the tender documents and construction contracts. Article 12 Where bulk cement or ready-mixed concrete is used in a construction project in accordance with the prescribed proportion, it shall, within 30 days from the date of completion of the project, apply to the municipal bulk cement management institution for special fund settlement procedures with the original vouchers for purchasing bulk cement or ready-mixed concrete, and implement the practice of refunding more and making up less.
