Regulations of Nanjing Municipality on Elevator Safety

Chapter I General Provisions Article 1 In order to strengthen elevator safety management and ensure the safety of people's lives and property, these Regulations are formulated in accordance with the Product Quality Law of People's Republic of China (PRC), the Law on Safety in Production of People's Republic of China (PRC) and the Regulations on Safety Supervision of Special Equipment of the State Council, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the production (including manufacture, installation, renovation and maintenance), sale, use, daily maintenance, inspection and testing of elevators and related supervision and management activities within the administrative area of this Municipality. Article 3 The municipal quality and technical supervision department is the administrative department in charge of elevator safety supervision and management in this Municipality, and the county (district) quality and technical supervision department is responsible for the supervision and management of elevator safety within its jurisdiction.

The administrative departments in charge of development and reform, planning, housing and urban and rural construction, industry and commerce, finance, public security and production safety supervision shall, according to their respective responsibilities, do a good job in elevator safety supervision and management. Article 4 The people's governments of cities and counties (districts) shall strengthen their leadership over elevator safety work and coordinate and solve major problems in elevator safety supervision and management.

Town People's Government (street offices) shall, in accordance with the provisions of these regulations, cooperate with relevant administrative departments to perform relevant duties according to law. Fifth elevator production units, users and daily maintenance units should strengthen the elevator safety management, establish and implement the safety management system to ensure the safe operation of elevators. Article 6 Elevator production units, daily maintenance units and inspection and testing institutions shall obtain licenses according to law, and their employees shall obtain corresponding qualification certificates according to law. Seventh to encourage the use of advanced technology and scientific management means, improve the safety performance and management level of elevators, and enhance the ability of accident prevention and emergency rescue.

Encourage elevator users to participate in elevator safety liability insurance. Eighth quality and technical supervision departments should strengthen the publicity of elevator safety laws and regulations and elevator safety knowledge.

News media, schools and social organizations should carry out and participate in elevator safety publicity, advocate civilized elevator ride, and enhance public safety awareness and self-protection ability. Chapter II Production and Sales Article 9 Elevator manufacturing units shall conduct production in accordance with relevant national standards, industry standards and safety technical specifications, and be responsible for elevator quality and quality related to safe operation. When the elevator leaves the factory, it shall be accompanied by design documents, product quality certificates and installation and maintenance instructions required by safety technical specifications. Tenth elevator sales units shall establish elevator incoming inspection system and sales ledger, and be responsible for the quality and source legitimacy of the elevators they sell.

The elevator sales contract shall be in written form, and the after-sales service matters shall be stipulated. Eleventh elevator procurement in accordance with the law to implement the bidding system. Users should purchase elevators through bidding.

For affordable housing and other construction projects supported by government financial funds, the municipal housing and urban-rural construction department shall, jointly with the departments of quality and technical supervision, development and reform, organize experts to evaluate and demonstrate the safety performance, technical support, failure rate, after-sales service and credit evaluation of elevators, and strengthen the supervision and management of elevator procurement. Twelfth elevator quality and safety commitment system. The installation, renovation and major maintenance of elevators shall be carried out by the manufacturing unit or the unit entrusted, agreed and licensed according to law.

If the user entrusts a unit that has obtained the corresponding license according to law to transform the elevator, the transformation unit shall replace the nameplate of the elevator product, issue a quality certificate, indicate the name of the transformation unit, the license certificate number and the transformation date on the nameplate and quality certificate of the product, and be responsible for the elevator quality and the quality related to safe operation. Thirteenth elevator installation, renovation, major maintenance construction, the construction unit shall inform the municipal quality and technical supervision department in writing before the construction.

Elevator installation, renovation and major maintenance process shall be subject to the supervision and inspection of inspection and testing institutions; Those that fail to pass the supervision and inspection shall not be delivered for use.

Within 30 days after the elevator installation, renovation and major maintenance are completed and passed the supervision and inspection, the construction unit shall hand over the quality qualification documents and related technical data to the users, and provide daily maintenance for no less than one year free of charge. Fourteenth manufacturing units shall provide users with elevator spare parts, as well as technical guidance and services for the safe operation of elevators, and assist in the development of professional skills training such as emergency rescue.

The manufacturing unit shall not set up technical obstacles to cause the elevator to stop running periodically and repeatedly, which will affect the normal operation of the elevator.

When the elevator stops periodically and repeatedly, the user should inform the manufacturing unit, and the manufacturing unit should make corresponding technical explanations in time and assist in troubleshooting. Chapter III Use Article 15 An elevator user shall ensure the safe use of the elevator.

The use of units shall be determined in accordance with the following provisions:

(a) self-management, the elevator owner is the user;

(two) commissioned by the management of property services companies, property services companies for the use of units;

(three) the newly installed elevator has not been handed over to the owner, and the project construction unit is the user;

(four) * * * owns the property right, and the owner shall clearly use the unit through a written agreement;

(5) If the elevator owner rents, lends or otherwise transfers the right to use the place containing the elevator, the user may be agreed as the user.
