The transportation administrative department of the municipal and district people's governments (hereinafter referred to as the transportation department) is the competent department of highway management within their respective administrative areas.
The highway management agencies of the municipal and district transportation departments shall be specifically responsible for the road administration of national, provincial, county and township roads in accordance with the prescribed functions and powers.
Planning, urban construction, public security, land, water conservancy, city appearance, industry and commerce administration and other departments shall, within the scope of their respective functions and duties, coordinate in road administration. Article 5 The transportation department shall strengthen the maintenance of highway products, and keep highway facilities intact and highways unblocked.
Citizens, legal persons and other organizations are not allowed to occupy or destroy highway property, and have the right to report and stop the occupation and destruction of highway property.
The transportation department shall commend and reward the meritorious personnel who report and stop the violation of these regulations. Chapter II Highway and Highway Land Management Article 6 Within the scope of highways and highway land, the following acts are prohibited:
(a) set up shacks, stalls, farmers' markets, maintenance yards, parking lots, car washes, gas stations and other similar facilities;
(2) Mining, earth borrowing, fertilization, kiln burning, blank making, wasteland burning, water diversion irrigation, threshing, crop planting and other similar operations;
(3) discharging sewage, dumping garbage, waste soil and stacking materials;
(4) Filling or damaging drainage ditches, using highway bridges and culverts and drainage ditches to build dams and store water, and setting gates;
(5) Vehicle-borne goods touch the ground or are scattered or leaked;
(6) Laying pipelines for transporting flammable, explosive and toxic gases and liquids in highway bridges and highway tunnels;
(seven) other acts of occupation, destruction and pollution of highways and highway land. Article 7 Any unit or individual who needs to dig or occupy highways and land for highways must obtain the consent of the transportation department in advance, and must also obtain the consent of the public security department within the specified scope and time. If it is really necessary to extend the period of excavation or occupation, the unit or individual that excavates or occupies shall go through the extension formalities with the original approval department three days before the expiration. After the excavation or occupation is completed, it shall be accepted in accordance with the relevant provisions of the state; Without acceptance or unqualified acceptance, it shall not be delivered for use.
If a dam is used as a highway, and it is really necessary to dig or occupy a highway or highway land, it shall be reported to the water administrative department for approval after obtaining the consent of the transportation department.
If traffic needs to be interrupted because of digging or occupying roads or highway land, the traffic department and the public security department will jointly issue an announcement.
Units or individuals that have been approved to carry out construction operations shall set up obvious warning signs at the scene, hang warning red lights at night, and send people to divert traffic.
After the completion of the new high-grade highway, it shall not be excavated within five years. If excavation is really necessary, it shall be approved by the Municipal People's Government. Article 8 When building bridges, aqueducts, pipelines and other facilities across highways, long-term planning of highways should be considered, and the geometric dimensions and clearance requirements stipulated in technical standards for highway engineering should be met.
When setting up underground occupied facilities, it is not allowed to repeatedly dig roads and roads, which may not affect road facilities and traffic safety, and meet the prescribed distance requirements. Article 9 If all kinds of pipelines need to be repaired due to sudden failure, after taking necessary safety measures, they can dig or occupy highways and land for highways first, but they must go through the formalities with the relevant departments such as transportation within two days. Tenth it is forbidden to set up grade crossing on closed roads and closed sections or overlap with highways.
Where grade crossing is set on other highways or overlaps with highways, it shall be approved by the traffic and public security departments, and shall be designed and built in accordance with the requirements of technical specifications for highway engineering. Eleventh it is forbidden to use expressway as a test site to test the braking performance of motor vehicles.
It is forbidden to carry out any activities to test and inspect the performance of motor vehicles on high-grade highways. Twelfth vehicles that exceed the load limit, height limit, width limit and length limit of highway bridges and tunnels are not allowed to drive on the highway. If it is really necessary to drive, it shall be approved by the transportation department, drive according to the route and time specified by the public security department, and bear the expenses incurred by the transportation department in taking technical protection measures and repairing the damaged road. Thirteenth motor vehicles are not allowed to drive on the shoulder.
Motor vehicles exceeding the approved load quality standards are not allowed to drive on the road. Article 14 After the highway is rerouted, expanded, rebuilt and bridged at the ferry, the original highway shall be produced in accordance with the following provisions:
(a) the building control area, continue to be used as a highway planning and construction land management;
(two) outside the building control area, if it is really necessary to change the use, it shall go through the formalities of change with the land management department; If it loses its use function and needs to be scrapped, it shall go through the formalities in accordance with the relevant provisions of the Land Administration Law of the People's Republic of China; No unit or individual may occupy it without going through the formalities of alteration or scrapping;
(3) If the original highway is expanded and rebuilt by means of foreign capital, loans and fund-raising, and the toll of crossing the bridge is collected after the ferry bridge is rebuilt, the original road property shall be evaluated and confirmed by the state-owned assets management department, and the price shall be included in the investment; After the completion of the project, unified road administration will still be implemented by the transportation department.
