Interim Provisions of Shenzhen Municipality on the Administration of Subway Construction

Chapter I General Provisions Article 1 In order to strengthen the management of subway construction in Shenzhen and ensure the smooth progress of subway construction, these Interim Provisions are formulated in accordance with relevant laws and regulations. Article 2 Shenzhen subway construction project is a major social public welfare urban infrastructure construction project invested by Shenzhen.

The subway construction mentioned in these Interim Provisions includes subway construction projects, ancillary projects, ground and above-ground track projects connected with the subway and comprehensive development along the subway. Article 3 The Shenzhen Municipal People's Government (hereinafter referred to as the municipal government) will incorporate subway construction into the long-term plan of Shenzhen's national economic and social development, and organize its implementation by stages.

People's governments at all levels and their relevant administrative departments shall, in accordance with their respective responsibilities, support and cooperate with subway construction.

All units and individuals have the obligation to support and cooperate with the subway construction, and shall not hinder or affect the subway project. Article 4 Subway construction shall follow the principles of overall planning, rational layout, phased construction, safety and high quality. Article 5 Shenzhen Metro Engineering Construction Headquarters (hereinafter referred to as "Shenzhen Metro Engineering Construction Headquarters") is the leading organization for decision-making and coordination on major issues of metro construction established by the municipal government.

City subway engineering construction headquarters office (hereinafter referred to as the city subway office) under the leadership of the city subway engineering construction headquarters, in accordance with the Interim Provisions to perform the following main duties:

(a) to implement the work arrangements and resolutions of the municipal government and the municipal subway engineering construction headquarters on subway construction;

(two) to consider the subway construction plan, consider the annual subway construction plan, investment arrangement and fund combination plan put forward by Shenzhen Metro Co., Ltd. (hereinafter referred to as the subway company), and supervise the implementation after being approved by the municipal subway construction headquarters;

(three) to study and consider the major issues of subway construction, operation and development, as well as foreign procurement and bidding;

(four) to supervise and manage the design, budget and safety quality of subway projects, and guide the implementation of subway localization;

(five) to coordinate and solve the land acquisition, demolition, transportation, urban management and related problems involving various departments in the process of subway construction;

(six) to handle other matters assigned by the municipal subway engineering construction headquarters. Article 6 As a legal person of subway construction projects, the subway company is specifically responsible for the implementation of subway construction in accordance with these Interim Provisions. Chapter II Planning and Management of Subway Construction Article 7 Subway construction shall be carried out in accordance with the provisions of the national capital construction project management and subway construction planning.

Shenzhen subway construction planning (hereinafter referred to as subway construction planning) includes the overall planning of subway network and the detailed planning of each line of subway network. The overall planning of the railway network in the base area of the subway construction project is organized and implemented by stages. Article 8 As a special urban planning, the overall planning of subway network shall be compiled by the municipal planning and land department according to the overall urban development planning and the overall urban public transport planning, and incorporated into the overall planning implementation after being audited by the Municipal Subway Office and reported to the Municipal Urban Planning Commission for approval. Article 9 The detailed planning of each line of the subway road network shall be organized by the subway company according to the overall planning of the road network, and shall be implemented by stages after being examined and approved by the municipal planning and land department. Article 10 The overall planning of the subway network and the detailed planning of each line of the subway network shall be supervised and implemented by the municipal planning and land department. Article 11 The revision of the overall planning of the subway network and the detailed planning of each line of the subway network shall be carried out in accordance with the preparation and examination and approval procedures of these Interim Provisions. Twelfth subway construction needs to requisition or recover the land according to the plan, and the municipal planning and land department is responsible for the requisition or recovery; Houses and other buildings and structures need to be demolished, and the municipal planning and land department shall organize the demolition and resettlement. Thirteenth communication, power supply, water supply, drainage, gas and civil air defense pipelines and facilities required for subway construction projects shall be provided by the municipal planning and land department to the subway company. In the investigation or construction of subway construction projects, if the pipeline and facilities are damaged due to unclear or untrue information, the subway company will not be liable for repair and compensation. Fourteenth subway construction units have the responsibility to protect the safety of communication, power supply, water supply, drainage, gas and civil air defense pipelines along the subway.

For the municipal public facilities invested and built by the government within the planned scope that must be demolished in the subway construction, the subway company shall set up temporary replacement facilities during the construction period and restore them after the construction. Fifteenth subway construction needs to be demolished, and the pipeline laid by the construction industry after approval shall be compensated by the demolition according to the original laying standard; If the pipeline needs to be re-laid or expanded, the cost shall be borne by the pipeline ownership unit.

When it is really necessary to permanently dismantle or temporarily relocate underground pipelines in subway construction, all pipeline ownership units have the responsibility to cooperate and negotiate to determine the pipeline relocation plan and assist in its implementation. Sixteenth units and individuals along the subway construction project have the obligation to provide the relevant information of their buildings to the municipal planning and land department and the subway company free of charge.

If the subway company needs to send personnel to enter the buildings of units and individuals for inspection, it shall issue an inspection notice to the units and individuals under inspection in advance. When the subway company needs to send personnel to enter the border management area or the military management area for inspection, it shall inform its management department in advance and handle the relevant documents.

When conducting the on-site inspection listed in the preceding paragraph, the staff of the subway company shall carry valid certificates and wear inspection marks.
