Chapter X Provisions on Length of Service

Article 38

General length of service refers to the working hours of employees whose wage income is their whole or main source of livelihood. When calculating the general length of service, it should include the length of service of the enterprise.

Article 39

The length of service of this enterprise is calculated according to the continuous working hours of employees in this enterprise. Those who leave the company shall be counted from the date of their last return to work in this enterprise. However, under any of the following circumstances, this restriction shall not apply:

A, where the enterprise management, enterprise administration or management to mobilize workers, before and after the transfer in the enterprise's length of service, should be calculated continuously. However, before liberation, the enterprise's length of service can only be calculated continuously if it needs to be transferred for business and has definite proof.

Second, the workers who worked in this enterprise before liberation and were forced to leave and return to this enterprise, if there is a definite proof, can be merged into this enterprise to calculate the length of service after being discussed and approved by the labor insurance committee.

Three, after liberation, the enterprise management organs, enterprise administration or employers to deploy domestic and foreign learners, their learning period and the length of service in the enterprise before and after the deployment, should be calculated continuously. Before liberation, the personnel transferred to study at home and abroad by the enterprise management organ, enterprise administration or employing unit, if there is a definite proof, except the length of service during the study period, the length of service of the enterprise before and after the transfer can be calculated together.

Fourth, after liberation, if the employees are transferred to other enterprises by the enterprise management organ because of the suspension or reduction of production, the length of service of the enterprises before and after the transfer should be calculated continuously. When enterprises resume work or expand production, laid-off workers will still return to enterprises, and the length of service before and after the demobilization of enterprises should be calculated together.

Five, after the transfer, reorganization or merger of enterprises, the original employees are still in the enterprise, and the length of service before and after the transfer, reorganization or merger is continuously calculated.

Six, work-related injuries during the medical period, should be regarded as the enterprise to calculate the length of service.

7. Those who have stopped working due to illness or non-work-related injuries for less than 6 months can continue to be employed to calculate the length of service for this enterprise; Workers who have returned to the original enterprise after more than 6 months of recovery, except for the period of more than 6 months, do not calculate the length of service, and the length of service before and after the enterprise should be calculated together.

Eight, under the reactionary rule of the puppet government and the Kuomintang, people who were forced to leave their jobs to resist their oppression, and those who were imprisoned by the puppet government and the Kuomintang government and continued to struggle during their resignation, before and after leaving their jobs or after being reinstated or transferred to other enterprises, the length of service of their own enterprises should be calculated continuously.

In order to meet the needs of the development of the socialist market economy and the flow of talents, through research, the relevant issues concerning the calculation of the length of service of the staff of government agencies and institutions are hereby notified as follows:

A, in non-public units or units under ownership by the whole people temporarily employed personnel, who signed an employment or labor contract with the work unit, and participated in the basic old-age insurance, after examination or recruitment to institutions, the payment years can be combined and calculated as continuous service.

Second, according to the voluntary resignation, dismissal of personnel, as well as the redemption of length of service adopted by the unit to reduce (divert) personnel. , more than the compensation standard stipulated by the state compensation. Five, the above personnel to calculate the length of service, from June 2006 onwards. In the past, wages, insurance benefits and other benefits related to calculating the length of service were not retroactive. Go through the examination and approval procedures by calculating the length of service, based on my personnel file records and historical data, and provide the original employment (labor) contract, old-age insurance payment voucher, degree certificate and other supporting materials.
