Measures of Tangshan Municipality on the Administration of Urban Rivers

Chapter I General Provisions Article 1 In order to strengthen the protection and management of urban river courses, ensure the safety of urban flood control and water supply, maintain the water environment of urban river courses and give full play to the comprehensive benefits of river courses, these measures are formulated in accordance with the Water Law of People's Republic of China (PRC) and other laws and regulations. "People's Republic of China (PRC) Flood Control Law" and "People's Republic of China (PRC) River Management Regulations", combined with the actual situation of this Municipality. Article 2 These Measures shall apply to rivers and their ancillary facilities within the urban area of this Municipality.

Urban rivers include Douhe River (from douhe reservoir exit to the junction of lunan district and Fengnan District), qinglong river River, Zhuanghe River in Li Ge, Longwangmiao River, Northwest Flood Drainage Canal and South Lake Flood Diversion Canal. Article 3 The municipal water administrative department is the administrative department of urban rivers. Urban river management units are specifically responsible for the management of urban rivers. Article 4 Urban river management units shall perform the following duties:

(a) the daily management, maintenance and conservation of urban rivers and their supporting engineering facilities;

(two) urban river flood control work;

(3) Dispatching and managing urban river engineering to ensure agricultural irrigation water supply, industrial emergency standby water source along the river and urban landscape water supply;

(four) other duties of river management that should be performed according to law. Fifth urban river flood control work by the municipal flood control headquarters unified command, the district flood control headquarters is responsible for the specific flood control work within its jurisdiction.

The operation of water conservancy facilities, tourist boats and floating facilities along the river shall be subject to the unified dispatch of the Municipal Flood Control Headquarters. Article 6 All units and individuals have the obligation to maintain the water environment of river courses, protect the integrity and safety of river courses, and participate in flood control and emergency rescue according to law, and have the right to stop or report acts of destroying river courses and their ancillary facilities. Chapter II Construction and Reconstruction Article 7 The overall urban planning and special planning organized by the planning administrative department shall conform to the urban flood control planning, and the opinions of the municipal water administrative department shall be sought in the process of compilation. Article 8 The development and utilization of waters, beaches, dikes and berms within the scope of urban river management shall be planned in an overall way and subject to the overall planning of flood control and urban development.

The utilization and construction of river shoreline shall meet the requirements of flood control safety and river regulation. Article 9 The scope of urban river management shall be reported to the municipal government for approval by the municipal water administrative department according to the urban blue line and after consulting the planning administrative department. Tenth city river regulation needs to occupy land, by the Municipal People's government to solve, and in accordance with the provisions of the land use procedures. Eleventh new construction, renovation and expansion of sewage outlets within the scope of urban river management, before the approval of the competent administrative department of environmental protection, shall solicit the opinions of the municipal water administrative department. Article 12 Greening within the scope of urban river management shall meet the requirements of river flood discharge, drainage, flood control and emergency rescue, engineering safety and soil and water conservation, and seek the opinions of the municipal water administrative department in advance. The municipal water administrative department shall not compensate for the inevitable loss of greening caused by flood discharge, flood control and emergency rescue, maintenance and other reasons. Thirteenth in the scope of urban river management, engaged in new construction, renovation and expansion of the following construction projects, shall be approved by the municipal water administrative department:

(1) Bridges, bridges, culverts, roads, pipelines, cables and other engineering facilities across rivers, rivers and dikes;

(two) dams, groins, culverts, aqueducts, canals, inverted siphons, water intake and drainage outlets and other projects;

(three) the construction of factories or other building facilities;

(four) engaged in tourism, leisure and entertainment development projects;

(five) other construction projects as prescribed by laws and regulations. Fourteenth municipal water administrative departments shall issue examination opinions within 20 working days after accepting the application for construction projects. Need to organize the demonstration, the required period is not counted. Fifteenth after the approval of a construction project, the construction unit or individual shall submit the design, construction arrangements and other documents to the urban river management unit before the start of construction, and sign a letter of responsibility to accept the supervision of the urban river management unit.

The project completion acceptance shall be attended by the municipal water administrative department, and can be put into use only after passing the acceptance. Sixteenth approved urban river management within the scope of construction projects, related wading projects should be constructed by units with water conservancy construction qualifications, and supervised by units with water conservancy construction supervision qualifications. Seventeenth approved to engage in construction activities within the scope of urban river management, occupying water engineering facilities or waters within the scope of the river, the construction unit or individual shall take equivalent substitution and remedial measures. Unable to take equivalent alternative measures, it shall be compensated in accordance with the relevant provisions; If the construction of the project causes damage to water engineering facilities such as river dikes or siltation of the river, the construction unit or individual shall be liable for compensation or dredging.

Units or individuals occupying land within the scope of river management shall bear the responsibility of maintaining water conservancy projects such as river dikes within the occupied area to ensure the safety of flood discharge and water supply in the river. Eighteenth municipal water administrative departments in accordance with the relevant provisions of the collection of river engineering construction and maintenance management fees and urban river resources income, paid in full to the municipal finance, into the fund budget revenue.
