Measures of Harbin Municipality on the Administration of Public Phones

Chapter I General Provisions Article 1 In order to strengthen the management of public telephones, promote the development of communications and meet the needs of economic and social development, these measures are formulated in accordance with the Regulations of Heilongjiang Province on the Development and Protection of Posts and Telecommunications and other relevant provisions, and in combination with the situation in our city. Article 2 These Measures shall apply to the administration of public telephones within the administrative area of this Municipality. Article 3 The term "public telephone" as mentioned in these Measures refers to telephone facilities approved by the telecommunications department and set up in public places such as streets, residential areas, along highways, etc. to provide communication services for the public, and collect communication fees according to regulations. Including ordinary public telephones, coin-operated public telephones and card-type public telephones (including magnetic cards and ic cards). Article 4 The Municipal Comprehensive Economic Operation Department shall supervise and manage the implementation of these Measures.

The municipal telecommunications department is responsible for the daily management of the public telephone operation in the city.

County (city) telecommunications department is responsible for the daily management of public telephone operation within their respective administrative areas.

Price, municipal utilities, public security, postal services, health, commerce, education, tourism, transportation and other departments shall assist in the management of public telephones. Article 5 The telecommunications departments of cities and counties (cities) shall protect the communication safety of public telephones.

All units and individuals have the obligation to protect public telephone communication facilities, and have the right to stop and report acts that damage public telephone communication facilities. Chapter II Establishment Management Article 6 The telecommunications departments of cities and counties (cities) shall, according to the population and the demand for public telephones, prepare the plan for the establishment of public telephones in their respective administrative areas.

The setting of public telephone shall conform to the planning of public telephone setting. Seventh the following places should be set up in accordance with the provisions of the public telephone:

(1) Public telephones shall be set up in the post and telecommunications business premises;

(two) airports, stations, docks, hotels, restaurants, shopping malls, hospitals, colleges and universities, residential areas, tourist spots, entertainment places and roads should be equipped with public telephones as needed;

(3) The streets and roads shall be provided with public telephones as required;

(four) night foreign business premises should be set up according to the need for emergency public telephone at night.

City, county (city) telecommunications departments should develop coin-operated public telephones and card-type public telephones. Eighth public telephone facilities on both sides of the street and other facilities occupying the road shall go through the examination and approval procedures with the administrative departments of public security and municipal utilities in accordance with the regulations. Article 9 When it is necessary to install public telephone lines on buildings such as houses, bridges and tunnels, the relevant departments shall support and allow the installation. Tenth city and county (city) telecommunications departments can start and provide public telephone services on their own, or entrust units and individuals to handle public telephone services. Eleventh units or individuals to apply for public telephone service, need to bring a letter of introduction or identity card to the city, county (city) telecommunications department to apply for procedures.

City, county (city) telecommunications department shall conduct on-site investigation within 30 working days after receiving the application from the unit or individual. In line with the conditions, it shall sign an agency agreement with the agent and issue a "Public Telephone Agency Certificate"; Do not meet the conditions, it shall promptly notify the applicant.

The agency agreement signed between the telecommunications department and the agent user shall specify the rights and obligations of both parties and the way to solve the dispute. Twelfth the following persons shall not act as public telephone agents:

(four) other personnel who are not suitable for acting as agents. Thirteenth agents to suspend business, should apply to the city, county (city) telecommunications department 30 days before the closure, after approval and settlement of telephone charges, can terminate business. Fourteenth public telephone lines, numbers, telephones, meters, signs and telephone booths and other facilities are provided by the municipal telecommunications department. The expenses of public telephones, meters, signs, telephone booths and other facilities shall be borne by the agent. Fifteenth any unit or individual shall not confiscate the public telephone facilities without the consent of the city and county (city) telecommunications department. Sixteenth any unit or individual shall have the following acts:

(a) unauthorized transfer of public telephone facilities;

(two) damage or theft of public telephone facilities;

(3) Overlaying telephones, fax machines or other communication terminal equipment on public telephone communication lines without authorization;

(4) stuffing inflammable and explosive articles, damp articles, dirty articles and other sundries into unattended card-type public telephones and coin-operated public telephones. Chapter III Service Management Article 17 The public telephone service includes the following contents:

(1) Local or local network call: for the speaker to talk with local or local VoIP users;

(three) conditional can run domestic and international long-distance telephone and fax services. Eighteenth public telephone service hours:

(1) The service hours of public telephones set up in the business premises are the same as the business hours or opening hours of the setting unit;

(2) Public telephones set up in non-business premises and handled by units or individuals shall start service before 7: 00 every day from April 1 day to1October 3 1 day, and shall not stop service before 17: 00; 1October 1 1 to March 3 of the following year1,and the service shall be started before 7: 00 every day, and the service shall not be suspended before 19: 00;

(3) 24-hour coin-operated and card-type public telephone service;

(4) Emergency public telephones provide services from 2/kloc-0 at night to 8: 00 the next day.

The agent shall strictly observe the service hours and shall not suspend business without authorization.
