Jiangsu: Not high enough to be rejected by the unit. Candidates sued the personnel bureau and were rejected.

Xinhuanet Nanjing April 1 1 (Reporter Wang Junyong) The written test and interview results are among the best, but the recruited units refused to hire because of their lack of height. A social candidate in Jiangsu took the Personnel Bureau to court. A few days ago, Haimen City Court rejected candidate Zhao's request on the grounds that the litigation reason was not established.

In August, 2006, Haimen Personnel Bureau announced the "General Rules for Recruitment and Employment of Staff in Municipal Institutions" to the public through websites and other media, and decided to openly recruit some staff in institutions. Zhao applied for the post of administrative law enforcement officer of Haimen Urban Management Bureau, and his written test and interview results were among the best. However, because his height is only 1.65 meters, which does not meet the requirement that the height of urban management team members should be above 1.70 meters, he was not hired in the end.

Zhao believes that there are no restrictions on the appearance requirements such as height and weight in the General Standard for Physical Examination of Civil Servants (Trial) formulated by the state, so there is no legal basis for the restrictive requirements on the height of candidates in the Guide. As a result, Haimen Personnel Bureau filed a complaint with the court.

The defendant argued that the height requirements set according to the particularity of urban management law enforcement posts were in line with relevant regulations, and there was nothing wrong with not hiring the plaintiff.

The court held that the laws and regulations did not prohibit the relevant departments from setting height conditions for the staff of public institutions, and the provision that "candidates must have physical conditions that meet the post requirements" in the Interim Provisions of the Ministry of Personnel on Open Recruitment of Staff of Public Institutions can be used as a reference for the defendant to set height conditions for the post of Urban Management Bureau.

At the same time, according to the approval of Jiangsu Provincial People's Government, Haimen Urban Management Bureau has some public security administrative powers and is a special post. Therefore, it is reasonable for the defendant to set the height conditions of the hired personnel with reference to the Physical Examination Items and Standards for People's Police Employed by Public Security Organs. Therefore, it is not illegal for the defendant to refuse employment on the grounds that the plaintiff's height does not meet the recruitment conditions, so the plaintiff's claim is rejected according to law.
