Chapter I General Provisions

Article 2 These Regulations shall apply to the planning, construction and management of urban parks invested by the government or donated by natural persons, legal persons and other organizations within the administrative area of this Municipality.
Where there are other provisions in laws and regulations on the planning, construction and management of scenic spots, forest parks, wetland parks and memorial parks, those provisions shall prevail.
Article 3 The term "city park" as mentioned in these Regulations refers to a public place with good landscape and complete supporting facilities, which has the functions of improving ecology, beautifying the environment, leisure and entertainment, cultural fitness, popular science propaganda and disaster prevention and avoidance, and is open to the public. Including comprehensive parks, characteristic parks (forest parks, wetland parks, memorial parks, waterfront parks, etc.). ), community parks and gardens.
Article 4 The development of urban parks shall adhere to the principles of government leading, social participation, unified planning, standardized construction and scientific management.
Article 5 The urban management departments of the people's governments of cities and counties (cities, districts) shall be responsible for organizing the implementation of these Regulations, the park authorities shall be responsible for the supervision and management of urban parks under centralized management, and other relevant departments shall do a good job in the management of urban parks according to their respective duties.
Park management unit is responsible for the daily management and service of city parks. Encourage the government to purchase services to determine the park management unit.
Sixth city parks implement directory management. The catalogue of city parks shall include the name, category, location, area, scope, protection and control requirements and management units.
The determination and adjustment of the list of urban parks shall be put forward by the competent department of urban management of the people's government of the city or county (city) in accordance with the relevant norms and standards, and shall be announced to the public after being approved by the people's government at the same level.
Article 7 The people's governments of cities and counties (cities, districts) shall incorporate the development of urban parks into the national economic and social development plan, ensure the necessary funds for the planning, construction and management of urban parks, and accelerate the construction of urban parks.
Eighth to encourage natural persons, legal persons and other organizations to participate in the construction, management and service of city parks through donations, funding and voluntary services.
Chapter II Planning and Construction
Ninth city, county (city) people's government departments in charge of urban management should be based on the overall urban planning and land use planning, in conjunction with planning and other relevant departments to organize the preparation of special planning for urban parks.
City, county (city) people's government shall report to the Standing Committee of the people's Congress at the corresponding level on the implementation of urban and rural planning, and report on the preparation, revision and implementation of special planning for urban parks.
Tenth city park planning and construction shall meet the following requirements:
(a) planning and construction of characteristic parks in combination with historical humanities, national characteristics, natural resources protection and diversified needs of citizens;
(two) planning and construction of residential areas of more than five hectares, more than five percent of the land must be reserved for the implementation of urban park construction;
(III) The transformation of the old urban areas should be combined with the overall urban and rural construction, the improvement of urban and rural environment, the scale of transformation and the layout of surrounding parks, and community parks and gardens should be planned and built according to the requirements that citizens can travel 500 meters to see the park green space, and corresponding facilities should be equipped;
(4) Reasonably set up parking lots and bus stops matching the scale of urban roads and parks to ensure the effective connection between the traffic microcirculation in the park and the slow traffic systems such as urban greenways and green corridors.
Eleventh city park special planning should solicit the opinions of experts and the public through demonstration meetings and hearings, and the publicity time of the draft special planning shall not be less than thirty days.
Before the approval of the special planning of city parks, it shall be submitted to the Standing Committee of the people's congress at the corresponding level for deliberation. City, county (city) people's government to study and deal with the deliberation opinions, and report to the Standing Committee of the people's Congress at the corresponding level for approval and implementation.
Twelfth city parks designated by the special planning of city parks, except for national key projects and major urban infrastructure projects, no unit or individual may occupy or change the nature of its land.
If it is really necessary to change the nature of urban park land because of the circumstances specified in the preceding paragraph, the people's government of the city or county (city) shall implement the balance of occupation and compensation, make up the qualified plots, build urban parks simultaneously with the project construction, and organize the revision of the special planning of urban parks in accordance with the procedures specified in Article 11 of these regulations.
Thirteenth new construction, renovation and expansion of city parks, the construction unit shall organize the preparation of the design.
The design scheme shall meet the following requirements:
(a) in line with the approved special planning of city parks;
(two) in line with the park design specifications and related technical standards;
(3) Conforming to the surrounding environment and natural conditions;
(four) supporting facilities that meet the requirements of ecological environment protection.
Article 14 The design of urban parks should make full use of the original topography, water vegetation and other natural conditions. Give priority to local plants for landscaping, rationally allocate plant communities, pay attention to human landscape, national characteristics, ecological effects and cultural and artistic education connotation, and improve the quality and function of the park.
Fifteenth new construction, renovation and expansion of various buildings and structures in urban parks, their scale, shape, height and color should be coordinated with the park landscape and the surrounding environment, and shall not damage the natural landscape and human landscape.
Sixteenth city parks should be equipped with ecological toilets, direct drinking water equipment, maternal and child facilities and barrier-free facilities.
The municipal construction in city parks shall be incorporated into the planning and coordinated construction of city municipal works, and meet the requirements of relevant safety standards.
Chapter III Management
Seventeenth park management units shall perform the following duties:
(a) to establish and improve the city park management system;
(two) responsible for safety management, environmental sanitation, landscaping, animal and plant protection, and maintaining the order of sightseeing;
(three) the management and maintenance of urban park facilities and landscape;
(four) the management and standardization of amusement, fitness, cultural entertainment and commercial supporting services in urban parks;
(five) to establish and improve the archives of city parks and keep them properly;
(six) to stop acts that violate the laws, regulations and management systems of urban parks, and to guide social organizations and individuals to participate in the management and service activities of urban parks;
(seven) to formulate emergency plans;
(eight) other duties as prescribed by laws and regulations.
Eighteenth city park facilities maintenance, garden management and environmental sanitation shall meet the following requirements:
(a) buildings, structures and all kinds of facilities, signs, signs in good condition, in line with technical specifications, damaged or missing facilities have been repaired or replaced in time;
(two) ancient and famous trees and their reserve resources, cultural relics and historical buildings are well protected;
(three) vegetation varieties to adapt to growth, beautiful shape, fine maintenance;
(four) lakes, pools and other landscape water bodies are clean, and the water quality conforms to the national "Environmental Quality Standard for Surface Water in Landscape Waters";
(five) the environment is clean and tidy, in line with the national health city standards.
Article 19 The safety management of city parks shall meet the following requirements:
(a) Regular maintenance of facilities to ensure safe operation;
(2) Dangerous areas should have safety warning signs and protective measures, and fitness and entertainment facilities should have safety warning signs;
(3) Organize emergency drills regularly, take emergency measures according to the emergency plan when an emergency happens, and report to the relevant administrative departments immediately;
(four) to ensure that barrier-free facilities are in good condition and unobstructed;
(five) scientific and reasonable setting of video surveillance, lighting and broadcasting facilities;
(six) do a good job in fire prevention, flood control and lightning protection, and promptly investigate all kinds of potential safety hazards.
Twentieth city park facilities and venues should be set up in accordance with the approved city park special planning and related standards. No unit or individual may build, rebuild or expand the supporting service facilities and venues of city parks without authorization, and may not change or destroy the original features and patterns of buildings and structures in city parks due to operation.
It is forbidden to use pavilions, platforms, buildings, pavilions and other garden buildings in urban parks for business.
It is forbidden to set up private clubs in urban parks and other projects that change the attributes of public resources.
Twenty-first no unit or individual may hold profit-making publicity activities in city parks.
Holding public welfare exhibitions and publicity activities shall abide by the relevant provisions of safety management, sign an agreement with the park management unit, and carry out it within the agreed scope and time, and shall not damage the landscape and facilities of urban parks or affect the normal order. After the event, the organizer should restore the site to its original state in time.
Article 22 The competent department of environmental protection shall reasonably set up noise monitoring facilities that can display the monitoring results in real time in city parks. The noise generated by various sports, fitness, cultural and recreational activities in urban parks shall not exceed the regional environmental noise emission standards.
From 12: 30 to 15 and from 2 1 to 7: 00 the next day, it is forbidden to use public broadcasting equipment or engage in other activities that produce excessive noise and interfere with the living environment of surrounding residents.
Park management units shall set up billboards in prominent positions in urban parks and main activity areas of fitness and entertainment to inform urban parks of environmental noise emission standards and prohibitions.
Twenty-third city parks prohibit motor vehicles and electric bicycles from entering the area outside the parking lot, except the following vehicles:
(a) police cars, fire engines, ambulances, engineering rescue vehicles, as well as electric power, water, communications and other operating vehicles;
(two) vehicles that perform management tasks such as sanitation and maintenance in the park, and sightseeing bus in the park;
(three) the official vehicles of the park management unit and the domestic vehicles of the residents in the park;
(four) vehicles that need to pass through the road due to emergency management.
Vehicles allowed to enter the park shall drive and park in accordance with the time, route and speed specified by the park management unit.
Twenty-fourth urban management departments should, according to the actual situation, determine the list of urban parks where dogs and other animals are prohibited from entering, and announce it to the public. Disabled people who need to carry guide dogs and disabled dogs are excluded.
When dogs are brought into the park, leashes with a length less than 2 meters should be used for effective restraint, and excrement should be cleaned immediately.
Park management units shall set up billboards in a prominent position in urban parks to inform the prohibited items or related precautions for bringing dogs and other animals into the park, and perform the duties of dissuasion.
Twenty-fifth city parks prohibit the following acts:
(a) over railings, hedges, spitting, urinating, littering;
(2) Swimming, roller skating, fishing, barbecue and camping in non-designated areas;
(three) set up stalls, scaffolding, stocking poultry and livestock;
(four) damage to lawns, flowers and trees, arbitrary injury, hunting and release of animals;
(5) scribbling, hanging, posting and distributing product advertisements;
(six) damage to buildings, structures, landscapes, facilities and equipment;
(7) Setting off fireworks, lanterns and burning paper money;
(eight) other acts in violation of laws and regulations.
Twenty-sixth public security organs shall, in conjunction with the competent department of city management, establish a fast and long-term law enforcement guarantee mechanism to strengthen the support and guarantee for law enforcement in city parks.
Twenty-seventh park authorities and park management units shall establish a supervision mechanism and inspection mechanism, and publish the telephone number of accepting complaints and reports in a prominent position in the city park, and accept the supervision of the public and the news media.
Chapter IV Legal Liability
Article 28 Anyone who, in violation of the provisions of Article 20 of these regulations, uses pavilions, platforms, buildings, pavilions and other garden buildings in urban parks to conduct business, or sets up private clubs and other projects that change the nature of public resources in urban parks, shall be ordered by the competent department of urban management to make corrections, and may be fined between 1 10,000 yuan and 30,000 yuan.
Twenty-ninth in violation of the provisions of article twenty-first, held in the city park for-profit promotional activities, the city management department shall order it to make corrections, and impose a fine of more than two thousand yuan and ten thousand yuan. If losses are caused, it shall be liable for compensation according to law; Without signing an agreement with the park management unit to hold public welfare exhibitions and publicity activities in the city park, the city management department shall order it to make corrections, and if losses are caused, it shall be liable for compensation according to law.
Thirtieth in violation of the provisions of article twenty-second, engaged in physical fitness, cultural and recreational activities in the city park, resulting in noise exceeding the regional environmental noise emission standards; From 12: 30 to 15, from 2 1 to 7: 00 the next day, those who use public broadcasting equipment or engage in other activities that cause excessive noise to interfere with the living environment of the surrounding residents shall be given a warning by the competent urban management department and ordered to make corrections; Refuses to correct, at more than two hundred yuan to five hundred yuan fine.
Thirty-first in violation of the provisions of article twenty-third, driving a vehicle into the city park without authorization, or not in accordance with the provisions of the park management unit, the city management department shall give a warning and order it to make corrections; Refuses to correct, at more than fifty yuan to two hundred yuan fine.
Article 32 Whoever, in violation of the provisions of Article 24, brings dogs and other animals into the Forbidden City Park, or enters the city park without effective restraint according to the provisions, shall be ordered by the city management department to make corrections within a time limit; Refuses to correct, at more than two hundred yuan to five hundred yuan fine.
Bring dogs and other animals into the city park that has entered, and do not immediately clean up the excrement, and the city management department shall order it to make corrections; Those who refuse to make corrections may be fined between twenty yuan and fifty yuan.
Thirty-third in violation of the provisions of the first and second items of this Ordinance, the city management department shall order it to make corrections within a time limit; Refuses to correct, at more than twenty yuan to one hundred yuan fine.
In violation of the provisions of article twenty-fifth of the third and fourth, shall be ordered to make corrections; Refuses to correct, at more than one hundred yuan to five hundred yuan fine; If losses are caused, it shall be liable for compensation according to law.
In violation of the provisions of the provisions of article fifth to article seventh, shall be ordered to make corrections; Refuses to correct, a fine of two hundred yuan and one thousand yuan; If losses are caused, it shall be liable for compensation according to law.
Thirty-fourth urban management departments may entrust park management units that meet the requirements stipulated in the Administrative Punishment Law of the People's Republic of China to implement the administrative penalties stipulated in Articles 30 to 33 of these regulations.
Thirty-fifth refuse or obstruct the city management administrative law enforcement personnel and city park management personnel to perform their duties according to law, and shall be punished in accordance with the "People's Republic of China (PRC) Public Security Management Punishment Law"; If a crime is constituted, criminal responsibility shall be investigated according to law.
Thirty-sixth park management units in violation of the provisions of this Ordinance, do not perform management duties and relevant provisions, the city management department shall order rectification within a time limit; If the circumstances are serious, the directly responsible person in charge and other directly responsible personnel shall be punished according to law; The park management unit determined by the government purchase service shall be replaced in time.
Article 37 If the competent department of urban management and other relevant administrative departments fail to perform their duties as stipulated in these Regulations and commit any of the following acts, the directly responsible person in charge and other directly responsible personnel shall be punished by their units, the competent department at a higher level or the supervisory organ according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law; If losses are caused to the parties concerned, they shall be liable for compensation according to law:
(a) failing to prepare or modify the special planning of city parks according to the regulations;
(two) changing the scope and nature of park land without authorization;
(three) the illegal implementation of administrative punishment;
(four) complaints and reports are not handled according to law, resulting in adverse consequences;
(five) other acts of abuse of power, dereliction of duty, favoritism.
Chapter V Supplementary Provisions
Article 38 These Regulations shall come into force on March 20 19 1 day.
