Chapter 1 General Provisions Article 1 In order to strengthen the management of construction project application and construction bidding, promote fair competition in the construction market, ensure project quality and improve investment efficiency, and adapt to the needs of the socialist market economy, According to the "Management Measures for Bidding and Tendering for Engineering Construction" of the Ministry of Construction and the actual situation of our city, these measures are formulated. Article 2 Any new, renovated or expanded building and installation project within the planning area of ??this city with a construction area of ??more than 1500M2 (including 1500M2) or a cost of more than 800,000 yuan (including 800,000 yuan) (except for sole proprietorships), All construction projects must be submitted and submitted for bidding in accordance with these Measures. Article 3 The Hefei Urban and Rural Construction Commission is the administrative department in charge of application and bidding for construction projects in this city.
The Hefei Municipal Tendering and Tendering Management Office (hereinafter referred to as the Municipal Tendering Office) is jointly composed of the Hefei Municipal Construction Management Office and the Hefei Branch of China Construction Bank. It is specifically responsible for the comprehensive management, supervision and inspection of construction bidding and bidding in this city. Work, its main responsibilities are as follows:
(1) Implement the bidding laws, regulations and rules issued by the country and the province, and formulate relevant bidding implementation rules in the region;
(2) Establish a construction market;
(3) Review the qualifications of bidding units;
(4) Review bidding applications and bidding documents;
(5) Review and determine the lowest bid ;
(6) Organize and supervise bid opening, bid evaluation, bid determination and bid negotiation;
(7) Mediate disputes in bidding activities;
(8) Reject the bidding results that violate the bidding regulations;
(9) Supervise the signing and performance of the contract. Chapter 2 Construction Application Article 4 The construction unit must apply to the Municipal Construction Management Office for construction application procedures while applying for a construction project planning license, and fill in the construction project application application form (attached).
Key projects approved by the relevant provincial authorities or relevant national ministries and commissions do not need to be reported for construction, but must be reported to the Municipal Construction Management Office for record. Article 5: The Municipal Construction Management Office shall verify and classify the contents of construction projects submitted, and publish bidding information in the construction market regularly or irregularly. Article 6 After the construction project submitted for construction is reviewed and approved by the Municipal Construction Management Office, the construction unit shall handle the project quality supervision, bidding, construction contract signing, review and other procedures in accordance with relevant regulations. The Municipal Construction Management Office shall issue a "Construction Management Plan" "Permit", the construction unit issues a construction permit. Article 7: For construction projects that should be reported for construction according to regulations but have not been reported, the Municipal Construction Management Office will not issue a "Construction Permit" and the project shall not start. Chapter 3 Bidding Article 8 If a construction unit meets the following conditions, it may enter the construction market and organize bidding on its own after applying to the Hefei Municipal Construction Management Office for review and approval:
(1) Having legal person qualifications;
(2) Have engineering management, budget management, and financial management personnel suitable for the project;
(3) Have the ability to prepare bidding documents and prepare base bids;
(4) Have the ability to review the qualifications of bidding units and organize bid evaluation and determination.
Construction units that do not meet the above conditions can entrust an engineering consulting company, supervision company or similar professional consulting unit with legal person qualifications to serve as a bidding agent. Article 9 To implement bidding for engineering projects, the following conditions must be met:
(1) The construction project has been submitted for construction;
(2) There is an approved project investment plan (large and medium-sized projects (According to the approved expanded design estimate), construction drawings and construction drawing budget provided by qualified units;
(3) The sources of project construction funds and equipment have been confirmed;
( 4) The planned location has been approved by the municipal planning department;
(5) The acquisition, demolition, and three connections and one leveling of construction land have been basically completed;
(6) The bidding application has been submitted to the municipal bidding Review and approve. Article 10 Bidding may be conducted in the following ways:
(1) Public bidding. The bidding unit publishes bidding advertisements publicly through newspapers, magazines, radio or television.
(2) Invitation to tender. The bidding unit shall issue bidding notices or invitation letters to more than three construction enterprises with contracting qualifications.
(3) Bid negotiation. For engineering projects that are not suitable for public bidding or invitational bidding, bids can be negotiated with construction companies with corresponding qualifications with the approval of the Hefei Municipal Construction Management Office. The number of units participating in the bid negotiation shall not be less than two (including two).
Bid negotiation should be conducted according to the following procedures:
(1) The bidding unit shall clarify the principles and specific conditions for winning the bid for the negotiated project;
(2) The bidding unit prepares the construction drawing budget and quotes;
(3) The bidding unit hosts the "bid negotiation" meeting and conducts a comprehensive evaluation based on the bidding unit's corporate reputation, technical quality, mechanical equipment, construction period, quotation, etc.;
(4) The Municipal Bidding Office participates in the "bid negotiation" meeting and mainly performs supervision and management responsibilities;
(5) Issues a bid winning notice. Article 11 Construction bidding for construction projects may adopt methods such as bidding for all projects, bidding for individual projects, bidding for specialized projects, and renewal of bids. Article 12 The bidding work shall be carried out according to the following procedures:
(1) The construction unit shall fill out the bidding application form and submit it to the Municipal Bidding Office for approval.
(2) The construction unit shall prepare bidding documents, bid bases, formulate bid evaluation and bid determination methods, and submit them to the Municipal Bidding Office for approval.
(3) The construction unit issues a bidding advertisement or bidding invitation letter.
(4) The Municipal Bidding Office will work with the construction unit to review the qualifications of the bidding units.
(5) The construction unit shall send bidding documents, design drawings, technical information, etc. to qualified bidders.
(6) The construction unit organizes the bidding units to conduct on-site inspections and answer questions on the bidding documents.
(7) The Municipal Bidding Office, together with the construction unit and other relevant departments, organizes the opening of bids, reviews and evaluates the bid documents, and determines the winning bidder.
(8) Issue a bid winning notice.
